As it is known that in our country, institutions of higher education and their higher bodies regulated by the provisions of the Constitution (Articles 130 and 131) and the Higher Education Law (Law No. 2547). According to the Constitution (Article 131), the only Superior Body of Higher Education is The Council of Higher Education (CoHE, YÖK). The Council of Higher Education is composed of members appointed by the President of the Republic from among candidates who are nominated by the Council of Ministers and universities, and in accordance with the numbers, qualifications and procedures prescribed by law, and of members directly appointed by the President of the Republic. On the other hand, universities, as public legal entities having autonomy, separate organs and their duties, shall be regulated by law. In spite of the special provisions of the Constitution, there are some provisions in Higher Education Law, regulating the Inter-university Council (IUC, ÜAK) as a higher bodies of higher education and giving the duty to nomination of members for CoHE, which we consider them being in conflict with the Constitution. In this study we will discuss (IUC, ÜAK), academic advisory and a decision-making body in some academic matters, regulated as a supreme body of higher education and having the duty on examination for associate professorship and nomitation of member for CoHE, in spite of related Constitutional provisions, from the perspective of Constitutional and Administrative Law
