Haksız rekabet davası, medeni usul kanunlarında açıkça düzenlenen bir dava türü değildir. Haksız rekabetle mücadele, marka hakkının ve diğer fikri ve sınai hakların korunmasına yönelik bir dava türü olarak ortaya çıkmıştır. “Haksız Rekabet Davası” isimli ve yedinci ve son basısını 2013 yılının son aylarında yapan kitabın ilk yazarı Wilhem L.Pastor isimli hukukçudur.
