Abstract:

International law, apart from ensuring the sustainability of interstate relations in accordance with the law, also aims at the peaceful resolution of disputes that arise in this process. It is observed that the existing traditional methods of resolving international disputes have undergone a transformation. It is important to examine the status and current solution potential of these traditional methods. With the effect of globalization and digitalization, a huge source of information called "big data" has emerged. It is seen that big data constitutes an important resource in the extra-judicial and judicial resolution of international disputes. In addition, big data analysis stands out as an effective method and tool that can be used in the resolution of interstate disputes. In the universe of disputes in which states, international organizations, international companies, and individuals are parties, the use of big data for resolution has become inevitable. However, this process must be carried out in accordance with international law and universal standards. International agreements, international human rights documents and ethical principles introduce various criteria in the management of the big data analysis process. However, there is a need for a unique international agreement that will bind all the elements for the implementation of big data in the international dispute resolution process. Although this international agreement is inspired by previous traditional texts, it should be designed in accordance with the dynamic nature of technology.
