Suriye iç savaşı başladığından bu yana savaşın şiddetinden en çok etkilenen ülkelerden biri Türkiye olmuştur. Bu makale, Türkiye’nin iç savaş sürerken DEAŞ ve PYD/YPG terör örgütlerinin hedefi haline gelmesi nedeniyle Suriye’ye yapmış olduğu en kapsamlı harekâtlardan biri olan Zeytin Dalı Harekâtı’nı sınır ötesinde meşru müdafaa hakkı bağlamında analiz etmektedir. Bu harekâtın incelenmesinin nedeni, uluslararası toplumda operasyonun meşru olup olmadığının sorgulanmasıdır. Buna rağmen akademik literatürde bu konuda herhangi bir çalışma bulunmamaktadır. Makale, literatürdeki bu boşluğu doldurmayı hedeflemektedir. BM Antlaşması ve uluslararası hukuk normlarında belirtilen meşru müdafaa hakları bir araya getirilerek sistematik bir çerçeve sunulmaktadır: silahlı saldırı olması, BMGK’nın bilgilendirilmesi, orantılılık ölçütü, zorunluluk ve aciliyet ilkeleri. Bu prensipler birincil kaynaklar yoluyla; BM ve BMGK’nın sınır ötesinde terörle mücadele ve Suriye iç savaşına yönelik kararlarıyla analiz edilecektir. Bu araştırma, Türkiye Zeytin Dalı Harekâtı’nda DEAŞ ve PYD/YPG ile mücadele etmek ve sınırlarını güvence altına almak için meşru müdafaa hakkına uygun şekilde hareket ettiği sonucuna varmıştır.
Turkey has been one of the countries most affected by the violence since the start of the Civil War in Syria. This article analyzes the Turkey’s Olive Dale Movement, which is one of the most comprehensive movements it has done against Syria because of the ISIS and PYD/YPG terrorist organizations becoming the target during the Civil War, in the context of the legitimate right of defense beyond the border. The reason for the study of this movement is the question of whether the operation is legitimate in the international community. However, there is no study in academic literature on this. The article aims to fill this emptiness in literature. A systematic framework is presented by combining the legitimate rights of defence specified in the United Nations Treaty and international law: armed attack, informing the United Nations General Assembly, proportionality measurement, mandatory and emergency principles. These principles will be analyzed through primary sources; by the decision of the United Nations and the UN General Assembly to fight terrorism beyond the borders and the Syrian Civil War. This research has concluded that Turkey has acted in accordance with the right of legitimate defense to fight ISIS and PYD/YPG in the Olive Dali Movement and to safeguard its borders.
