Abstract:

A complaint against the actions and procedures made by the administration in the tender process can be made to the administration, and the public tender body can be appealed by the form of complaint. The public procurement council, which is the decision body of the institution, decides on the applications made through the complaint. The Board has three kinds of decision-making authority on the applications made. These are the cancellation, correction process determination and rejection decisions given about the administrative savings on the subject of the complaint. However, it may be found that in some of the Council’s decisions, other than these three types of decisions, some decisions are made. In this study, both the types of decisions that can be made during the tender process are discussed in detail and the different types of decisions made by the institution are also included in the examination. In addition, considering that the most effective way of audit in the rule of law is the way of judicial audit, it has been beneficial to the examination of the institution’s decisions as well as the judicial audit.
