“Yerel yönetimler, yerel halkın mahalli müşterek ihtiyaçlarını karşılamak üzere kurulan, merkezi idarenin dışında örgütlenen, idari ve mali özerkliğe sahip ve karar organları seçmenler tarafından oluşturulmuş kamu tüzel kişilikleridir.”. Bu idarelerde zaman içerisinde bazı yasal düzenlemeler yapılmıştır. 2012 yılında yapılan 6360 Sayılı Düzenleme de bunlardan bir tanesidir. Bu yasal düzenlemede büyükşehirlerin sayısının artmasından, belde belediyelerin kapatılmasına, köylerin mahalleye dönüşmesinden, yeni ilçe belediyelerinin kurulmasını ilişkin değişiklikler söz konusudur. Bu çalışmada 6360 Sayılı Yasal Düzenleme ile köylerin tüzel kişiliğinin kaldırıp, mahalleye dönüşmesi ve bu durumun ilçe belediyelerine etkisi Kırıkhan Belediyesi özelinde ele alınmıştır. Temel kavramsal çerçevenin ele alınmasının ardından nitel görüşme sonucunda elde edilen verilerle köylerin kapatılıp mahalleye dönüşmesinin ilçe belediyesine etkisi Kırıkhan İlçe Belediye başkanı ile yapılan mülakat yöntemiyle değerlendirilmiştir. Hazırlanan mülakat sorularıyla yasal düzenleme derinlemesine analiz edilmiştir. Çalışma sonucunda bu yönde yapılan düzenlemenin hem yerel idareleri hem de yerel yönetimlerden hizmet alan vatandaşı da etkilediği ortaya çıkmıştır. İlçe belediyeleri için bütçe, personel, yeki uyuşmazlığı ve özellikle sorumluluk alanının genişlemesi gibi sorunların ortaya çıktığı sonucuna varılmıştır.
“Local governments are public legal entities established to meet the needs of local people by local clients, organized outside the central administration, with administrative and financial autonomy and established by voters in the decision-making bodies.” There have been some legal arrangements in the time. The number 6360 in 2012 is one of these. This legislation is about the increase in the number of major cities, the closure of municipalities, the transformation of villages into neighborhoods, the establishment of new municipalities. In this study, the Legal Regulation No. 6360 and the removal of the legal personality of the villages, the conversion to the neighborhood and the impact of this situation on the district municipalities were addressed in the private district of Kırıkhan Municipality. After the basic conceptual framework was addressed, the data obtained as a result of the quality discussion and the impact of the village closed and converted into neighborhood to the district municipality was assessed by the method of the interview with the mayor of Kırıkhan District. The prepared interview questions have been thoroughly analyzed with the legal arrangement. The study found that the arrangement made in this direction affected both the local authorities and the citizens who served from the local authorities. Local authorities, which have administrative and financial autonomy, have been established to meet the basic local needs of local people, have been elected decision makers, and are referred to as local government. Some legal regulations have been made in these administrations over time. The Regulation No. 6360, which was held in 2012, is one of them. The study found that the regulation in this direction affects both local governments and the citizen serving from local governments. It has been concluded that problems such as budget, staff, fiscal dispute and especially the enlargement of the area of responsibility have emerged.
