Özet:

In this research, the historical development of the investigation phase, one of the phases in our criminal procedure law, has been examined. In this context, it has been examined how and by whom the investigation phase was carried out in the historical process, especially the systems that affect the investigation phase in criminal procedure. In our study, based on the available information, how the investigation phases were carried out in the Sumerian, Roman, Common Law and Enlightenment periods, and the stages of the historical development of the investigation phase in Turkish law were examined. Considering the historical development, it is understood how important the current social and political situation was in shaping the investigation phase. In today's world, where individual rights and freedoms are given great significance, the importance of the investigation phase has shown itself. Within this framework, in the first headline of our study, the accusation and investigation systems and the cooperation (mixed) system in criminal procedure, which we think are important in terms of shedding light on the historical perspective, are explained. In the second headline, the historical process that affected the formation of the investigation phase in our criminal procedure law was examined, starting from the Sumerian law.
