Bu çalışmada, Osmanlı son döneminde meydana gelen adam öldürme suçları ve bu suçlar aydınlatılırken takip edilen süreçler incelenmektedir. Çalışma genel olarak XIX. yüzyıl ikinci yarısı ile XX. yüzyıl başlarını kapsamakta olup Cumhurbaşkanlığı Osmanlı Arşivi belgeleri, ikinci el kaynaklar ve dönemin mesleki bir dergisi olan Polis Mecmuası’ndan faydalanılmıştır. Benzer çalışmalarda ülke geneli veya herhangi bir vilayetteki genel asayiş durumu incelenip suçların sayı ve sebeplerine yoğunlaşılırken bu çalışmada, devletin öldürme suçlarının aydınlatılarak faillerinin yakalanmasına verdiği önem ve kolluk kuvvetleriyle adli görevlilerin bu süreçte takip ettikleri usuller incelenmektedir. Çalışmanın sonunda, Osmanlı Devleti’nin öldürme suçu faillerinin hak ettikleri cezalara çarptırılmaları için hukuki alt yapıyı oluşturduğu, bu suçların maddi delillerle aydınlatılmasına büyük önem verdiği, adli ve mülki görevlilerinden de bu beklenti içerisinde olduğu tespiti yapılmıştır. Görevlilerin ise bu beklentiye cevap verme adına sıcak takip, ifade alma gibi klasik yöntemlerin yanı sıra dönemin konuyla ilgili gelişmelerini de yakından takip ederek parmak izi, fotoğraf, adli tıp hizmetleri, bazı biyolojik analizler yaptırma gibi imkanları da kullandığı ve bilirkişiler aracılığı ya da kendi tecrübeleriyle delilleri kriminalistik incelemelerden geçirdikleri ortaya konulmaktadır.
This study examines the crimes of murder that occurred in the last Ottoman period and the processes followed when these crimes are illuminated. The work is generally 19. The second half of the 20th century. It covers the beginning of the century and has been taken advantage of the Presidential Ottoman Archive documents, second-hand sources and a professional magazine of the time, the Police Mecmuasi. In similar studies, the general assurance situation in the country or any province is examined and focused on the number and causes of the crimes, while in this study, the importance of the state’s murder crimes is illuminated and the law enforcement forces and the procedures that the judicial officers follow in this process. At the end of the study, the Ottoman State found that the murder crimes of the Ottoman State formed a legal substructure for the punishment they deserve, that these crimes were highlighted with material evidence, and that the judicial and property officials were also in this expectation. For the purpose of responding to this expectation, the officials also use the possibilities such as fingerprint, photo, judicial medical services, some biological analysis, and through the knowledge persons or through their own experience, the evidence has been passed through criminal investigations.
This study examines the murder crimes in the last period of the Ottoman Empire and the procedures followed when solving these crimes. The study covers generally the second half of XIX. century and the beginning of the XX. century. Documents from the Presidential Ottoman Archives, second-hand sources and a professional journal of the period called "Police Journal" was used in the study. While in similar studies the focus was on the number and causes of crimes after examining the general order of public in a country or city, this study focused on the importance attached by the state to solving crimes of murder and finding the perpetrators and the methods used by law enforcement officers and judicial agents in that process. At the end of the study, it was found that the Ottoman State had created the legal infrastructure for punishing murderers, attached great importance to the elucidation of these crimes with material evidence, and expected the same of judicial and civil agents. The responsible agents used methods including fingerprint, photography, used forensic services and some biological analyses in light of the related developments of the time as well as the traditional methods such as hot pursuit and taking statements. They also put the evidence through criminalistic examinations using experts and their own experience.
