Abstract:

In this article, the part-whole relationship is discussed on principled, methodological, and functional levels, on the axis of integrity protection, especially in a theoretical context. As an example of the principled level, it is emphasized that all of the legal principles should be included in the legal processes as a whole in the context of the principles of "the judgment belongs to Allah,", "consistency," and "ease." On the methodological level, this time, it is stressed that each of the literal, historical and final interpretation methods -without highlighting one of them, should be included in the process of establishing a link between legal texts and concrete events. On the functional level, it is underlined that each of the functions of law to create order, meet social needs and establish justice should be brought together in a balanced way. Then, in the context of protecting integrity in practice, the perspectives of the ulama on the part-whole relationship and the substitution of "more than half," "half," or "less than half" for the whole are emphasized. The article is ended up with expressing the results.
