6098 sayılı Türk Borçlar Kanunu m.72/I’e göre, haksız fiillere ceza kanunlarındaki zamanaşımının uygulanabilmesi için haksız fiilin cezalandırılabilir olması ve bu fiil için ceza kanunlarında öngörülen zamanaşımının haksız fiillere uygulanan iki yıllık “nispi” ve on yıllık “mutlak” zamanaşımından uzun olması gerekmektedir. Ancak, ceza kanunlarındaki zamanaşımı; uygulanma alanı, başlangıcı, durma ve kesilme nedenleri yönünden nispi ve mutlak zamanaşımı sürelerinden farklıdır. Bu ise ceza kanunlarındaki zamanaşımının haksız fiillere uygulanmasında sorunlara neden olmaktadır. Bu çalışmada, ceza kanunlarındaki zamanaşımı kavramı, bu zamanaşımının uygulanma şartları, cezalandırılabilir haksız fiilin ve tazminat sorumlularının nitelikleri ele alınmaktadır. Ceza kanunlarındaki zamanaşımının haksız fiillerdeki uygulanma şekli konusunda uygulamada ortaya çıkabilecek sorunlara çözümler getirilmektedir.
According to Article 72/I of Turkish Code of Obligations No. 6098, in order to implement the statute of limitations in criminal laws to errors, this tort shall be punishable and the statute of limitations in criminal laws for this act shall be longer than two-year "relative" and ten-year "absolute" statutes different from the relative and absolute statutes of limitations regarding their implementation areas, beginning and grounds for suspension and interruption of the period. This leads to problems in the implementation of the statute of limitations in criminal laws to errors. In this study, the concept of statute of limitations in criminal laws and rerequisites for its implementation, the features of punishable errors and persons responsible for compensation are discussed. The solutions for possible questions regarding the way of implementation of the statute of limitations in criminal laws to errors are offered.
