Abstract:

In this study, Article 199 of Turkish Civil Code, which includes a provision about some legal acts of spouses that can be valid with the consent of the other spouse, will be examined. The general aim of this article is to prevent spouses from consuming the financial resources of family, guarantee the future of the marital relationship and to protect the peace in the family. When a danger related to these subjects appears, upon the demand of a spouse, the judge may decide to restrict the disposition power of the other related to specific assets. Additionally, the legislature authorized judges to take any measures necessary for more effective results in the enforcement of this decree. Where the restriction is imposed on the disposition power over any immovable (real) property possessed by the spouse, the judge may decide that an annotation will be put in the land registry
