A successful prosecution of crimes and the principle of the presumption of innocence require the confidentiality of criminal prosecutions. Persons involved in a prosecution, such as the judges, prosecutors, witnesses and experts, are subject to the requirement to keep the prosecution proceedings confidential. If there is more than one suspect in a prosecution, each suspect can only disclose the proceedings concerning himself and must keep confidential the proceedings about the other suspects. Similarly, the defense attorney can only disclose the prosecution proceedings concerning his own client as opposed to the other suspects subject to the same prosecution. Although the members of the press are not among the persons directly involved in the prosecution proceedings, they are subject to the requirement for the confidentiality of prosecution to a certain extent as per Article 19/1 of the Press Law. Acts violating the confidentiality of prosecution are criminalized by Article 285 of the Turkish Criminal Code and Article 19/1 of the Press Law
