Toplantı ve gösteri yürüyüşü hakkı demokratik toplumlarda temel bir unsurdur. Özgürlüklerin kullanılmasında genel olarak serbestlik, izin ve bildirim olmak üzere üç farklı sistem öngörülmektedir. Türkiye’de anayasal düzenleme, toplantı ve gösteri yürüyüşü hakkının önceden izin alamadan yapılacağını belirtmektedir. İlgili Kanun’da ise bildirim usûlü öngörülmüştür. Bildirim usûlünün kullanımı, amacına uygun gerçekleştirilmediği zaman fiilen izin sistemine dönüşme riskini taşımaktadır. Dolayısıyla bildirim usûlü Anayasa’da güvence altına alınan izin almadan kullanılacak bu hakkı işlevsiz hale getirmeyecek şekilde düzenlenmeli ve uygulanmalıdır. Bu çalışmada, bildirim usûlü gerek Anayasa Mahkemesi gerekse İnsan Hakları Avrupa Mahkemesi kararları da dikkate alınarak açıklanacak ve incelenecektir.
The right to meet and demonstrate is a fundamental element in democratic societies. There are three different systems for the use of freedoms: freedom, permission, and communication. In Turkey, the right to constitutional arrangements, meetings and demonstrations will be made without prior permission. In the law, the information is provided in advance. The use of the notification process carries the risk of converting it to the actual permission system when it is not performed in accordance with its purpose. Therefore, this right to be used without the permission guaranteed in the Constitution should be regulated and applied in such a way that it does not disfunction. In this study, the decision of the European Court of Human Rights will be declared and examined in consideration by the Constitutional Court.
The right to hold meetings and demonstration marches is a fundamental right in a democratic society. Usually three different systems are provided in the use of freedoms: freedom, authorization and notification procedure. The system of authorization is forbidden under the Turkish Constitution regarding to hold meetings and demonstrations. In the related Law, the notification procedure is regulated. When the notification procedure is used out of its purpose, it may turn into the authorization system in practice. Therefore, the notification procedure which is guaranteed under the constitution should be regulated and implemented in a way that may not lead this right to dysfunctional. In this study, the notification procedure will be explained and examined by considering the decisions of both the Constitutional Court and the European Court of Human Rights.
