It is important to ensure the right to the protection of family and property in enforcement proceedings, particularly in accordance with the principle of proportionality. It is vital to ensure the right to family protection is provided, especially when seizing property or where the enforcement process involves taking a child or establishing a personal relationship with a child. The opportunity for family members to object to enforcement proceedings is a way in which the right to the protection of family is served. In enforcement law, the right to the protection of property is taken into consideration for the creditor, debtor and third parties. The only limitation on any fundamental right when carrying out enforcement proceedings must be made in accordance with the principle of proportionality.The aim of this article is to evalutate the right to the protection of family, the right to property and the principle of proportionality during enforcement proceedings in the Turkish Republic of North Cyprus. Another aim is to examine the ways in which such rights can be violated and suggestions are made as to how such rights can be procured. The provisions in Turkish law are referred to in footnotes and a comparision is made to the regulations in the Turkish Republic of North Cyprus
