Yenileme Alanlarında Kentsel Dönüşüme Uygulanabilecek Temel İlkelere Dair Bir Değerlendirme

Abstract:

Kentsel dönüşüm uygulamasının, kültür ve tabiat varlıkları korumasına tabi olan yenileme alanları üzerinde gerçekleştirilmesi, 5366 sayılı Kanunla yasal dayanak bularak hukuken meşruiyet kazanmıştır. İlgili kanunla, yenileme alanlarının tespiti, teknik altyapı ve yapısal standartlarının belirlenmesi, projelerin oluşturulması, uygulama, örgütlenme, yönetim, denetim, katılım ve kullanıma ilişkin usul ve esaslar düzenlenerek kentsel dönüşüm mümkün hale gelmiştir. Ancak mezkur kanuni düzenlemeye rağmen her iki kavramın sahip olduğu farklı hukuki zeminler ve uygulamada gerçekleşmesi muhtemel ihtilaflar dikkate alındığında ilkeler üzerinden bütüncül bir değerlendirme yapılmasının gerekli olacağı düşünülmüştür. Bu kapsamda, gerek kültür tabiat varlıklarını koruma hukuku gerekse de kentsel dönüşüm uygulamalarına ilişkin temel ilkeler çerçevesinde bir değerlendirme yapılarak tüm ilkelere değinmenin mümkün olmadığı anlaşılmış olup yenileme alanlarında gerçekleşecek dönüşüme uygulanabilir ve özgünlüğe sahip önemli ilkeler tercih edilmiştir. Çalışmamızda bu ilkeler, “kentsel dönüşümün ikincilliği”, “sosyal dokunun ve yaşam biçimlerinin korunması”, “dönüşümün çok boyutluluğu”, “süreklilik/sürdürülebilirlik”, “yerinde dönüşüm”, “önce zarar vermeme”, “koruma kullanma dengesinin sağlanması” olarak tercih edilmiştir. Öte yandan özünde tartışmalı olan kentsel dönüşüm uygulamasının yenileme alanlarında gerçekleştirilmesi, başlı başına ihtilaflı kabul edildiğinden içerik ve konunun özgünlüğü dikkate alınarak ilkeler üzerinden sağlıklı bir değerlendirme yapılması büyük önem taşımaktadır. Bu nedenle uygulamanın, her iki alanı da kapsayan ve uygulama açısından bütüncül ve çok boyutlu bir sonuç doğuracak

Abstract:

The implementation of urban transformation on the renovation areas subject to the protection of cultural and natural assets has gained legality in law by finding legal basis by Law No. 5366. With the relevant law, the identification of renewal areas, the determination of technical infrastructure and structural standards, the procedure and principles relating to the creation of projects, implementation, organization, management, control, participation and use have made urban transformation possible. However, despite the legislative arrangement, it is believed that a comprehensive assessment of the principles would be necessary to take into account the different legal backgrounds and practices that both concepts possess and the possible disputes that occur in practice. In this context, it was understood that it was not possible to refer to all the principles by making an assessment within the framework of the fundamental principles concerning the protection of cultural and natural assets, and that important principles with originality were preferred to be applied to the transformation that will take place in the fields of renewal. In our study, these principles were preferred as “the secondary of urban transformation”, “the preservation of social touch and way of life”, “the multi-dimensional transformation”, “sustainability/sustainability”, “sustainability in place”, “not damaging in advance”, “protecting the balance of use of protection”. On the other hand, the implementation of the urban transformation practice, which is in its essence controversial in the renewal areas, is of great importance to make a healthy assessment over the principles, taking into account the originality of the content and subject, since it is considered controversial in itself. Therefore, the application will generate a comprehensive and multi-dimensional result that covers both fields and in terms of application.

The implementation of urban transformation on renewal areas subject to the protection of cultural and natural assets has been legally legitimized by finding a legal basis with Law No. 5366. With the relevant law, urban regeneration became possible by regulating the procedures and principles related to the determination of the areas, technical infrastructure and structural standards, creation of projects, implementation, organization, management, supervision, participation and utilization. However, despite the aforementioned legal regulation, thinking about the different legal grounds of both concepts and possible disputes in practice, it is considered necessary to make a holistic evaluation based on the principles. In this context, after an evaluation has been made within the framework of both the law of protection of cultural natural assets and the basic principles of urban transformation practices,it is understood that it is not possible to refer to all principles. Therefore, important principles that are applicable and original to the transformation in the renovation areas have been preferred. In our study, these principles are preferred as “secondariness of urban transformation”, “protection of social fabric and lifestyles”, “multidimensionality of transformation”, “continuity/sustainability”, “onsite transformation ”, “do not to harm first” and “to maintain balance of protection”. Moreover, since the realization of urban transformation in renewable areas is considered to be disputed in itself, it is so important to make a healthy evaluation based on the principles considering the content and originality of the subject. For this reason, if the application is evaluated and limited by the principles covering both areas and having a holistic and multi-dimensional result in terms of application, it will be possible to stick to the characteristics of the renovation areas.
