Özet Hukuk felsefesinde değer problemi, ahlakla olan ilişkisini keserek, hukuka bağımsız bir alan belirlemekle ilgilidir. Hukuk alanında değerlerin problem haline gelmesinin nedeni, özellikle hukuki pozitivizm taraftarlarının hukuku bir bilim haline getirme çabaları olmuştur. Değerin bütünüyle reddedilmesi mümkün olamayacağı için, hukukta değer tartışmalarında asıl sorunun, değerlerin mutlak mı yoksa göreli mi olacağı sorusu üzerinde yoğunlaşmıştır. Bu tartışmada, değerlerin mutlak ve evrensel olduğunu savunan doğal hukuk yanlıları ile göreli ve sübjektif olduğunu öne süren hukuki pozitivistler karşıt görüşler ortaya koymuşlardır. Değerin rölatifliği üzerindeki tartışmaların mutlak bir bilinemezciliğe ya da şüpheciliğe dönüşmesi ortaya bir nihilizmi çıkaracaktır. Abstract The problem of value in legal philosophy is about determining an independent field for law by cutting off its relation with morality. The reason why values have become a problem in the field of law has been the efforts of the supporters of legal positivism to make law a science. Since it is not possible to completely reject the value, he focused on the question of whether the values will be absolute or relative, which is the main problem in value discussions in law. In this discussion, natural law advocates, who argue that values are absolute and universal, and legal positivists, who argue that values are relative and subjective, have put forward opposing views. The transformation of the discussions on the relativity of value into an absolute agnosticism or skepticism will reveal a nihilism. Considering the fact that values are ambiguous and sometimes relative, pointing out that turning the discussion into an absolute value relativism will have devastating consequences and developing a moderate thesis on this issue is the main subject of this article.
