Ombudsman, kökeni 18. yüzyıla kadar dayanan ve kamu yönetiminin devlet adına denetlenmesi için ortaya çıkmış bir kurumdur. Bu kurum, kamu yönetimini dışarıdan, bağımsız ve objektif bir biçimde denetlemektedir ve böylece kamu yönetimlerinde kötü yönetim uygulamalarını en aza indirmeyi ve insan hakları ihlallerini önlemeye çalışmaktadır. Ombudsman, günümüzde neredeyse tüm çağdaş devletlerde kurulmuştur ve bu kurum dünya boyunca yayılımını devam ettirmektedir. Ombudsman, özellikle demokrasi ve hukuk devleti ilkeleri ile özdeşleşmektedir. Bu bağlamda da günümüzde tüm dünya devletlerinin ilgisini çekmiştir. Günümüzde devletin ve kamu yönetiminin artan eylem ve faaliyetlerine karşılık olarak topluma sunmuş olduğu görev ve hizmet düzeyinde artışlar meydana gelmiştir. Bu çerçevede devletin artan hizmetlerine bağlı olarak denetimi de önemli bir konu haline gelmektedir. Ombudsman da devletin denetlenmesi konusunda önemli bir noktada bulunmaktadır. Bu makale çalışması, Türkiye’de ombudsmanın uygulanabilirliğini analiz etmektedir. Çalışmada Türkiye’de ombudsmanlık kurumunun uygulanabilirliğinin analiz edilmesi amacıyla Türkiye Kamu Denetçiliği (Ombudsman) Kurumu’nda gerçekleştirilen bir alan araştırmasına da yer verilmiştir. Bu alan araştırmasında, Türkiye Kamu Denetçiliği Kurumu’nda nitel ve nicel analiz yöntemleri kullanılarak görüşme ve anket yapılmıştır. Bu şekilde de kurumda bulunan kamu denetçileri ve uzmanlardan oluşan bir örneklem üzerinde ampirik veriler elde edilmiş ve yorumlanmıştır. Elde edilen verilerin analiz edilmesi sonrasında Türkiye Kamu Denetçiliği (Ombudsman) Kurumu’nun Türkiye açısından uygulanabilir olduğu tespit edilmiştir.
The Ombudsman is an institution that was founded in the 18th century and emerged for the public administration to be controlled on behalf of the state. This institution controls public administration from the outside, independently and objectively, and thus strives to minimize mal governance practices in public governments and prevent human rights violations. The Ombudsman is now established in almost all contemporary states and this institution continues to spread throughout the world. The Ombudsman, in particular, identifies the principles of democracy and the rule of law. In this context, it has attracted the interest of all the world states today. Today, the level of duty and service that the government and public administration has offered to society in response to increasing actions and activities has increased. In this context, due to the increased government services, the supervision becomes an important subject. The Ombudsman is also an important point in the supervision of the state. This article studies the applicability of the Ombudsman in Turkey. The study also included a field research conducted at the Turkish Public Audit (Ombudsman) Institution in order to analyze the applicability of the Ombudsman institution in Turkey. In this field research, discussions and surveys were conducted using qualitative and quantitative analysis methods at the Turkish Public Audit Authority. In this way, empirical data were obtained and interpreted on a sample of public auditors and experts in the institution. After the analysis of the data obtained, it was found that the Turkish Public Audit (Ombudsman) body was applicable to the Turkish view.
Ombudsman, dating back to 18. centuries is an institution emerged for the inspection of the public administration on behalf of the state. This institution, public administration is controlled outside, independent and objective manner and thus to minimize bad management practices and working to prevent human rights violations in public administration. Nowadays, the ombudsman has been established in almost all modern states and these institutions continues to spread throughout the world. The Ombudsman, in particular is synonymous with democracy and the rule of law. In this context, today it is attracting the attention of all the world’s governments. Nowadays, increasing the actions and activities of the public administration of the state and society, which is submitted in response to the increase in duties and level of service has occurred. In this context, depending on the state’s increasing control services are becoming an important subject. The Ombudsman has also an important point regarding the inspection of state. This article studies to analyze the applicability of the ombudsman in Turkey. In this study, the place has been given to an area of research in Turkey Ombudsman in order to analyze the applicability of the ombudsman institution in Turkey. In this field of research, were performed interviews and surveys using qualitative and quantitative analysis methods in Turkey Ombudsman. In this way empirical data obtained and interpreted on a sample ombudsman and experts in institution. After analyzing the resulting data, It has been found to be applicable for Turkey of the Turkey Ombudsman.
