An atypical contract agreement, named the team contract (agreement), was arranged in the Turkish Labour Act No. 4857 Article No. 16. This type of contract has existed in the Turkish labour legislation since the Labor Act of 1936, no. 3008. Team contract is a contract where a representative worker from a group of many workers, as the team leader, signs a contract with the employer, on behalf of all the other workers in the group. The parties of the contract are the employer and this team leader, who represents the team of the workers. This was initially intended to help keep under control the “individual job finding services”, which was quite common at the times when the official Turkish Employment Institution was not functional. Today, team contract is seen in fewer and fewer areas. However, this contract has the very potential to acquire many different functions in the labour life. This contract is, in fact, a quite flexible employment contract which enables the workers and the employer to sign a contract even without the mediation of a worker representative. Furthermore, today it might also be quite possible that the such agreements might also be used a means of negotiating a collective bargaining with the employer in sectors such as the film industry, where collective agreements are rare. In this study, the characteristics of the team contract are explored, the potential areas of application will be highlighted and also a comparison will be made between the team contract in Turkish labour law and the group contract in German labour law
