Toplu eylem hakkı, işçilerin ekonomik sosyal ve çalışma koşullarını olumsuz etkileyen karar ve uygulamalara karşı toplu olarak başvurdukları demokratik bir direnme hakkıdır. Toplu eylem hakkı, düşünce ve ifade özgürlüğü kapsamında değerlendirilen bir temel insan hakkıdır. Avrupa Sosyal Şartı, Avrupa İnsan Hakları Sözleşmesi, ILO Sözleşmeleri, Avrupa İnsan Hakları Mahkemesi Kararları, Avrupa Sosyal Haklar Komitesi Kararları ve ILO’nun Denetim Organları’nın kararlarına göre toplu eylem hakkı işçilerin işyeri veya diğer alanlardaki ekonomik ve sosyal menfaatlerini korumak için başvurdukları demokratik bir haktır. Bu çalışmada toplu eylem hakkının hukuki dayanakları, toplu eylem hakkının niteliği ve bu hakkın meşru sayılması için aranan şartlar tartışılmıştır.
The right to collective action is the right of the workers to collectively resist decisions and practices that negatively affect the economic social and working conditions. The right to collective action is a fundamental human right assessed within the framework of freedom of thought and expression. In accordance with the European Social Charter, the European Convention on Human Rights, the ILO Conventions, the European Court of Human Rights Decisions, the European Committee on Social Rights Decisions and the ILO Supervisory Authority Decisions, the right to collective action is a democratic right that workers apply to protect their economic and social interests in the workplace or in other areas. This study discussed the legal basis of the right to collective action, the nature of the right to collective action and the conditions sought to be considered legitimate.
