The Turkish/Swiss debt law has called for the person who has damaged as a rule to be defective. This is also called “forgiveness”. There are also cases in which a defect is sought for responsibility, and this is called "uncomprehensive/neutral/causable responsibility". Before the preparation of the new Turkish Debt Act No. 6098, the Turkish teaching had accepted two common types of perfect liability. The first of these was the state of perfect responsibility based on the essence of “dominity and benefit” and the state of perfect responsibility based on the essence of “danger” while the state of perfect responsibility based on the essence of danger, the person responsible is not recognized any possibility to get rid of the responsibility. Therefore, in the doctrine, the term increased causal responsibility for risk liability is also used. This study examined the new legal regulations introduced by the Turkish Debt No. 6098 on risk liability. Furthermore, the provisions of the comparative law on this issue have been discussed and the principles of the European Union Law have been evaluated.
