Doktrinde 2499 sayılı mülga SPK döneminde “manipülasyon” olarak adlandırılan, 6362 sayılı SPK’da ise “Piyasa Dolandırıcılığı” şeklinde düzenlenen suç tipinin bilgiye dayalı olarak işlenmesi, çalışmamızda hem maddi hukuk hem de muhakeme hukuku açısından iki bölüme ayrılarak incelenmiştir. İlk bölümde sermaye piyasası ve piyasa dolandırıcılığı kavramları hakkında genel açıklamalarda bulunularak, bunların tanımına ve amacına değinilmiştir. İkinci bölümde ise, bilgi bazlı piyasa dolandırıcılığı suçu ayrıntılı olarak açıklanmıştır. Bu kapsamda öncelikle söz konusu suç tipinde korunan hukuki değer irdelenmiş, sonrasında suçun maddi ve manevi unsurları ile hukuka aykırılık unsuru ele alınmıştır. Devamında bu suçun özel görünüş şekilleri olarak teşebbüs, iştirak ve içtima konuları incelenmiştir. Ayrıca bu suçta öngörülen özel soruşturma usulü olan, soruşturma yapılabilmesi için Sermaye Piyasası Kurulu tarafından Cumhuriyet Başsavcılığına yazılı başvuruda bulunulması ve bu başvurunun muhakeme şartı olması hususları ayrıntılı olarak açıklanmıştır. Son olarak, bu suçun işlenmesi sonucunda uygulanacak yaptırıma değinilmiştir.
In the doctrine of the property number 2499 in the SPK period called "manipulation" and in the SPK number 6362 in the form of "market fraud" the processing of the type of crime based on information, in our study, both material law and judicial law have been studied by dividing into two sections. In the first section, the general explanations on the concepts of capital markets and market fraud are referred to the definition and purpose of them. In the second section, the information-based market fraud crime is detailed. In this context, the legal value protected in the type of crime in question was first examined, then the material and spiritual elements of the crime and the element of law-controlling were addressed. It is continued to be investigated as a particular form of appearance of this crime, attempt, participation and internal issues. In addition, the special investigation procedure for this crime, which is provided for, is explained in detail the facts of the written application by the Capital Markets Board to the Republic's Prosecutor's Office for the investigation and that the application is a condition of judgment. Finally, the punishment to be applied as a result of the offence.
