Abstract:

Witness proof has a great place in the resolution of disputes encountered in the work life, and in the proof of non-written rules for the work system, the main evidence applied in the practice in the detection of the behavior of the parties. Once again, the documentation and records concerning the work order and the relationship are under the control of the employer, and when it is observed that it is not often possible for the worker to access the documents and records, the important evidence that the worker requests is the testimony. Although the witness is proof, the appreciation is proof, the work judgment is important in terms of proof of the existence of many cases of the worker. However, in some cases it may be difficult for the worker to get to the statements of the witnesses he wants to hear and to get to the statements of the cases he has or will proceed in the case. In our judgment law, the witness has been heard and the witness has been heard before the witness has arrived in the judgment stage and before the judgment begins. In this study, the proof detection institution will be assessed from the point of view of the work judgment, if necessary before the proceedings are opened or after the proceedings are opened, the proof detection and the proof of the proceedings will be assessed from the point of view of the employee.
