17. yüzyılda Avrupa’da ulus devletlerin ortaya çıkmasına kadar uzanan ve günümüzde de uluslararası ilişkiler disiplini açısından son derece önemli bir konuyu teşkil eden azınlıklar ve azınlık hakları, neofonksiyonalist teori ekseninde temellenen ve nihai amacı salt bir ekonomik topluluk olmaktan çıkıp siyasi bütünleşmeyi hedefleyen Avrupa Birliği (AB) açısından da önem arz etmektedir. Soğuk Savaş’ın bitişi ekseninde iki kutuplu dünya düzeninin sona ermesiyle ortaya çıkan yeni konjonktür, genel olarak dünya siyasetinde etnik, dini, dilsel ve ulusal azınlık sorunlarının yeniden gündeme taşınmasındaki fitili ateşleyen bir etken olurken, bir bütün olarak azınlık kavramı ve azınlık hakları konusunun AB düzleminde de tartışılmasına sebebiyet vermiştir. Bu bağlamda makale, hem AB’nin hem de AB’nin en önemli üyelerinden birini teşkil eden Fransa’nın genel olarak azınlıklara ve özel olarak Avrupa’da en geniş nüfusa sahip olan ve en fazla ötekileştirilme politikalarına tabi tutulan Romanlara yönelik politikalarını analiz etmeyi amaçlamaktadır. Öte yandan Kopenhang Kriterleri arasında bulunan “azınlık haklarına saygı gösterilip, korunması” ilkesinin AB’ne üye olmak isteyen aday ülkeler tarafından yerine getirilmesi zorunluluğu konusundaki hassasiyetin, kendi üyeleri tarafından yerine getirilip getirilmediği de sorunsallaştırılacaktır. Türkiye’deki akademik yazının bu konuya çok fazla ilgi göstermemesi bu yönde bir çalışma oluşturulmasında itici bir güç olmuştur.
The rights of minorities and minorities, which took place in Europe in the 17th century until the emergence of national states and today are an extremely important subject in terms of the discipline of international relations, are also of importance in terms of the European Union (EU), which is based on the neo-functionalist theory axis and the ultimate goal is to come out of being a purely economic community and aim for political integration. The new conjoncture that arises with the end of the two-pole world order in the end of the Cold War, becomes a flagship factor in the restart of ethnic, religious, linguistic and national minority issues in global politics, while the concept of minority and minority rights as a whole has led to the debate in the EU level. In this context, the article aims to analyze the policies of France, which is both one of the most important members of the EU and the EU, towards minorities in general and especially the Romans with the largest population in Europe and undergoing the most autonomous policies. On the other hand, the sensitivity on the obligation of the countries candidates to join the EU to comply with the principle of "respect and protection of minority rights" which is among the Copenhagen Criteria will also be questioned whether it is fulfilled by their own members. The fact that the academic paper in Turkey has not shown much interest in this topic has been a driving force in the creation of a study in this direction.
