This paper examines the inviolability of domicile and the punishment of its violation in Ottoman legal history. It was protected against not only attacks, but also violations of private life by Islamic law and orfi law (kanunname) during the classical age. In the Tanzimat era, the Penal Code of 1858 had a considerable impact on the concept of the inviolability of domicile. It will be tried to analyse the limits of the protection of the inviolability of domicile in light of Ottoman sharia court records and archival documents. Therefore, it concludes that the scope of inviolability of domicile has been expanded during the transition from Ottoman Empire to the Republic of Turkey
