Kriminolojiye dayalı klasik ceza hukukuna bir tepki olarak gelişen viktimoloji, daha ziyade, mağdura odaklanarak suçun sebebiyet verdiği zararları gidermeyi amaçlamaktadır. Bu yeni ilim dalı, suçtan dolaylı olarak etkilenen kişileri ifade etmek için “suçtan zarar gören” kavramını geliştirerek mağdur kavramının kapsamını genişletmiştir. Buna rağmen suçlu yakınlarını mağdur kapsamında değerlendirmemektedir. Çünkü suçlu yakınlarının mağduriyeti, suçluyu cezalandırma kapsamında değerlendirilmektedir. İslâm hukuku ise suç ve cezanın şahsiliği ilkesinden yola çıkarak suçlu yakınlarının yaşayacağı mağduriyetlerin de önüne geçmeyi amaçlamış ve bu bağlamda bazı hükümler koymuştur. Son yıllarda öne çıkan onarıcı adalet kavramının dayandığı mantıkla da örtüşen bu hükümler, suçlu yakınlarının mağduriyetini minimuma indirmeyi amaçlamaktadır. Bu amaçla bazı özel düzenlemeler yapılması, cezanın geciktirilmesi, sulh, arabuluculuk ve tahkim yöntemlerinin kullanılması, tövbe ve af yoluyla cezanın düşürülmesi, mahkûmlara mahrem hak ve sosyal imkânlar sunulması bunlardan bazılarıdır.
Victimology, which is developed as a response to the classical criminal law based on criminology, aims to remove the damage caused by the crime by focusing on the victim. This new branch of science has expanded the scope of the concept of the victim by developing the concept of "injured by crime" to express the persons indirectly affected by crime. However, the victim does not consider the victim's victims. For the victim’s victim is judged as a punishment. The Islamic law has aimed at preventing the victims of the crime and the personality of the punishment, and has set some provisions in this context. These provisions, which are also in line with the logic that the concept of corrective justice, which has emerged in recent years, aims to minimize the victimity of the victims' relatives. For this purpose, some special arrangements are made, the delay of the punishment, the use of the methods of submission, mediation and arbitration, the reduction of the punishment through repentance and forgiveness, the provision of private rights and social opportunities to prisoners.
