Elinizdeki çalışmada günümüz hukuk düşüncesine büyük katkıları olan ve kuramlarıyla güncel hukuki meseleleri halen etkilemeye devam eden iki önemli hukukçunun, Hans Kelsen ve Carl Schmitt’in “Anayasanın koruyuculuğunu kim üstlenmelidir?” sorusu etrafında yürüttükleri polemik ele alınmaktadır. Weimar Cumhuriyeti’nde anayasa yargısı sistemi bulunmamakla birlikte, anayasa yargısının meşruiyeti ve gerekliliği üzerine ikili arasında oldukça zengin ve yoğun bir tartışma yaşanmıştır. Polemiği başlatan 1931 tarihli “Anayasanın Koruyucusu” metninde Schmitt, Anayasa Öğretisi adlı çalışmasındaki görüşlerine dayanarak anayasayı varoluşsal bir temelde ve asli kurucu iktidarın aldığı politik kararların kurucu niteliği açısından açıklamaktadır. Bu bağlamda Schmitt’in anayasa kavramı politik olanla sıkı bir ilişki içerisindedir. Kelsen’in normativist pozitivist kuramı ise anayasayı normlar hiyerarşisinin üstünde konumlanan temel bir norm ve kapalı bir normlar sistemi olarak ele almaktadır. Schmitt’in eleştirilerine karşılık Kelsen “Anayasanın Koruyucusu Kim Olmalıdır?” metnini kaleme almıştır. Kelsen anayasanın koruyuculuğu rolünü üstlenebilecek mercii olarak anayasa mahkemesini, Schmitt ise devlet başkanını önermektedir. Elinizdeki çalışmada her iki düşünürün politik olanla kurduğu karşıt ilişki üzerinden kuramları karşılaştırılarak anayasal uyuşmazlıklara ilişkin çözüm önerileri incelenmektedir.
