6102 sayılı Kanunla Taşıma Hukukuna ilişkin hükümler büyük ölçüde CMR (Karayoluyla Uluslararası Eşya Taşıma Sözleşmesine İlişkin Sözleşme) ve Alman Taşıma Reform Kanunu ile paralellik arz edecek şekilde düzenlenmiştir. Çalışmamıza dayanak olan Türk Ticaret Kanunu (TTK) m. 879 hükmü de CMR m. 3 ve Alman Taşıma Kanunu’nun 428 inci paragrafı ile uyum içindedir. Maddede temelde yardımcılar iki gruba ayrılmıştır. Bunlar, taşıyıcının kendi adamları ve hizmetlerinden yararlandığı kişilerdir. TTK m. 879’da, mülga Kanun’da karşılık gelen hüküm olan m. 782’den farklı olarak, yardımcı kavramının sınırları “görevlerini yerine getirmeleri sırasındaki” ifadesi ile belirgin hale getirilmiştir. Değişiklikle beraber görev kapsamında hareket etme şartı her iki grup için de aranır hale gelmiştir. Bu çalışma ile amaçlanan, TTK. m. 879 ile getirilen somut taşıma fiilinde doğrudan görevlendirilmiş olma şartının taşıyıcının yardımcısı kavramının kapsamına ve taşıyıcının sorumluluğuna yansımasının incelenmesidir.
Provisions regarding the Law of Carriage of Goods by Code No. 6102 have been legislated by compatible with CMR (Convention on the Contract for the Intenational Carriage of Goods by Road) and TRG (Transportrechtsreformgesetz) substantially. The Turkish Commercial Code (TCC) 879 which is the basis of our study, is consistent with CMR art. 3 and TRG art. by 428. The article is basically divided into two groups, which are agents and servants. Limits of the concept of the carrier's assistant has been determined by expression of "while performing their duties" in art. 879 of the TCC unlike the art. 782 of abrogated law which is the provision corresponding to art. 879 of TCC prior to the amendment of the Law. With the amendment of the law, the requirement to act within the scope of the employment has been sought for both groups. The aim of this study is to examine the reflection of the requirement of being directly commissioned in the act of concrete transport, which is brought by the TCC article. 879, to responsibility of the carrier and scope of the concept of assistant.
