Arjantin’de Bilgi Edinme Hakkı Kanunu oldukça yakın bir tarihte, 2016 yılında kabul edilmiştir. Kanun, bilgi edinme hakkı açısından kendine has modern özellikler taşımaktadır. Bu modern özellikler arasında Bilgi Edinme Kurulu Başkanı’nın seçim usulü bulunmaktadır. Bu çalışmanın amacı temelde, Arjantin’de bilgi edinme hakkının, Arjantin Bilgi Edinme Hakkı Kanunu’nun sistematik olarak incelenmesi ve Kanun’un özelliklerini vurgulamaktır. Ayrıca Kanun’un yürürlüğe girmesinden önce bilgi edinme hakkıyla ilgili düzenlemeler, Kanun’un yürürlüğe girme süreci, bilgi edinme hakkı ile ilgili Arjantin Anayasası hükümleri, Amerika İnsan Hakları Sözleşmesi hükümleri ve Amerikan İnsan Hakları Mahkemesi’nin konuya yaklaşımını incelenecektir. Bu kapsamda; Arjantin’de bilgi edinme hakkı öncesi dönem, bilgi edinme hakkı ile ilgili anayasa hükümleri, Amerikan İnsan Hakları Sözleşmesi’nde bilgi edinme hakkı ve Amerikan İnsan Hakları Mahkemesi’nin bilgi edinme hakkına yaklaşımı, Arjantin’de Bilgi Edinme Hakkı Kanunu’nun kabul edilmesine yönelik süreç gözden geçirilecektir. İlave olarak kimlerin bilgi ve belge vereceği, kimlerin bilgi talep edebileceği, bilgi ve belgenin nasıl tanımlandığı, bilgi edinme usulü, istisnalar, Arjantin Bilgi Edinme Kurulu ve aktif şeffaflık gibi Arjantin Bilgi Edinme Hakkı Kanunu’nda düzenlenen konular bu çalışmanın alt başlıklarını oluşturacaktır. Sonuç olarak, Arjantin Bilgi Edinme Hakkı Kanunu’nun Amerika İnsan Hakları Sözleşmesiyle ve Amerikan İnsan Hakları Mahkemesi’nin bilgi edinme hakkı yorumuyla ve Mahkeme’nin bu hakla ilgili Maksimum Açıklık ilkesi gibi kriterleriyle uyum içinde olduğu söylenebilir.
In Argentina, the Law on the Right to Information was approved in a very recent date, in 2016. The law has its own modern characteristics in terms of the right to obtain information. Among these modern features is the procedure of election of the Chairman of the Information Acquisition Board. The aim of this study is essentially to systematically review the right to access information in Argentina, the Argentine Law on the right to access information and emphasize the characteristics of the Law. The provisions on the right to information before the law enters into force, the process of entry into force of the law, the provisions of the Argentine Constitution on the right to information, the provisions of the American Convention on Human Rights and the approach of the American Court of Human Rights to the subject will also be examined. In this context; the pre-period of the right to obtain information in Argentina, the constitutional provisions relating to the right to obtain information, the right to obtain information in the American Convention on Human Rights and the approach of the American Court of Human Rights to obtain information, the process for the adoption of the Law on the right to obtain information in Argentina will be reviewed. Additionally, the topics that are regulated in the Argentine Law on the Right to Obtain Information, who can request information, how the information and document are defined, the procedure for obtaining information, exceptions, the Argentine Information Council and active transparency will form the subtitles of this study. As a result, it can be said that the Argentine Law on the Right to Information is in accordance with the American Convention on Human Rights and the American Court of Human Rights’s interpretation of the right to information and the Court’s criteria such as the Principle of Maximum Disclosure relating to this right.
In Argentina, the Right to Information Act was passed quite recently, in 2016. The Act has unique modern features in terms of the right to information. Among these modern features is the method of choosing the Chairman of the Information Board. This study aims to systematically examine the right to information and the Argentine Right to Information Act in Argentina and to emphasize the characteristics of the Act. In addition, it also examines the regulations on the right to information before the Act comes into force, the enactment process of the Act, the provisions of the Argentine Constitution on the right to information, the provisions of the American Convention on Human Rights and the approach of the Inter-American Court for Human Rights to the subject. In this context; the period before the right to information in Argentina, constitutional provisions on the right to information, the right to information in the American Convention on Human Rights, and the approach of the Inter-American Court for Human Rights to the right to information, the adoption of the Right to Information Act in Argentina. By reviewing the process, issues like who can provide information and documents, who can request information, how to define the information and document, how to obtain information, exceptions, and Argentina Information Board that are regulated in the Act will form the sub-titles of this study. As a result, Argentina’s Right to Information Act is believed by the Inter-American Court for Human Rights’s view of the Americas regarding information, with the goal of maximum openness regarding that right.
