Uluslararası Göçmenlerin Türkiye’ye Uyumu Yasal Düzenlemeler Ne Derece Uyumu/Entegrasyonu Hedefliyor?

Türkiye, uluslararası göçmenler için üç türlü uyum politikası izlemektedir. Birincisi, kültürel olarak benzer bir topluluk oluşturma hedefi çerçevesinde Türk soylu ve Türk kültürüne bağlı uluslararası göçmen gruplarının uyum politikası, ikincisi ülkenin refahına katkı sağlayabilecek sosyo-ekonomik düzeyi yüksek, kamu düzeni ve güvenliğini tehlikeye atmayacak grupların uyum politikası, üçüncüsü ise sosyo-ekonomik düzeyi düşük uluslararası göçmenlerin geçici olarak ülkede barınmalarına olanak sunan ve ülkenin yasal kayıt sistemine entegre edilmelerini mümkün kılan “geçici” olarak nitelendirilebilecek yapıdaki bir tür uyum politikasıdır. Bu politikalar ile, Türkiye düzensiz göçle mücadeleyi temel almakta, sosyo-ekonomik düzeyi yüksek ve / veya Türk soylu göçmenlerin kalıcı olarak ülkede barınmalarını hedeflemektedir. Yabancılar ve Uluslararası Koruma Kanun (YUKK)’da tanımlanan uluslararası koruma statüleri de uluslararası göçmenlerden sadece Avrupa’dan gelenler için daha kalıcı uyum stratejisi belirlemiştir. Avrupa dışından gelenlerin ülkedeki kalıcılığı ise etnik aidiyetlerine ve sosyo-ekonomik düzeylerine göre değişmektedir. Makalenin temel iddiası, Türkiye’nin mevcut göç politikasının oluşum sürecinin başından itibaren uyumu haklarda eşit bir topluluk oluşturma perspektifinden tanımlamadığı, uluslararası göçmenlerin uyumunun, sosyal, ekonomik politik ve hukuki olarak parçalı olarak gerçekleştiği, uyum politikasının uygulama safhasında, konjonktürel gelişmelerle şekillenmekte olduğudur. Çalışmada yapılan değerlendirme, uyum konusu bağlamında tarihsel süreç içerisinde göç politikasının belli başlı yazılı dokümanlarının sistematik analizinin yapılması ve Ankara ve İstanbul’da Göç İdaresi Genel Müdürlüğü Uyum ve İletişim Daire Başkanlığı’nda çalışan uzmanlar ile yapılan yarı yapılandırılmış görüşmeler yoluyla gerçekleştirilmiştir.

Abstract:

Turkey follows three kinds of harmonisation policy for international migrants. The first objective is to create a culturally homogeneous community through the integration of migrants of Turkish origin and culture. The second is aimed at groups with a high socio-economic levels, who will contribute to the well-being of the country and not threaten public order and security. The third which can be described as a kind of "temporary harmonization policy", aims to allow international migrants with low socio-economic level temporarily accommodated in the country to be registered formally. The basic principle of these policies is to fight against irregular immigration while allowing migrants with high socio-economic level or of Turkish origin and culture to settle in the country permanently. In the Law on Foreigners and International Protection, the concept of harmonization is not clearly defined and its policy goals are not specified. The international protection status defined in this law defines a permanent harmonization strategy for migrants coming from Europe, while the permanence of migrants coming from non-European countries vary according to their ethnic identity and socio-economic status. The main argument of the article is that Turkish migration policy has never defined harmonization from the perspective of creating a community with equal rights. The harmonization of immigrants is socially, economically and legally fragmented and is shaped largely through the context of implementation. The study is based on the systematic analysis of the major written documents of immigration policy and semi-structured interviews with experts working in the Department of Harmonization and Communication in the Directorate General of Migration Management in Ankara and Istanbul.
