Osmanlı Devleti’nde Tanzimat Fermanı’nın ilânıyla birlikte hız kazanan modernleşme hareketi yeni kanunlar ve düzenlemelerle hukuk alanını da etkilemiştir. Kişisel haklardan, toprak ve miras hukuku gibi birçok alanda yapılan düzenlemeler içerisinde ceza hukuku da ele alınan konulardan biri olmuştur. Bedenî cezalardan hürriyeti kısıtlayıcı ceza uygulamasına doğru geçişin yaşandığı dünyada Osmanlı Devleti, bu değişime kayıtsız kalmamıştır. 19. yüzyılda hapis cezasının uygulandığı mahbeslerden hapishanelere doğru bir geçişin yaşandığı Osmanlı Devleti’nde, buna uygun olarak ceza hukukunda düzenlemelere gidildiği gibi hapis cezasının uygulanacağı fiziki mekânları oluşturmak için ülke genelinde bir ıslahat hareketi başlatılmıştır. Avrupa devletleri örneğinden hareketle hapishanelerin ıslahına yönelik idari ve hukuki adımlar atarken, mevcut hapis mekânlarının iyileştirilmesi, tamir ve onarımlarla hapishaneye dönüştürülmesi ile başlayan süreçte istenilen sonucun alınamaması üzerine devlet yeni hapishanelerin inşasına hız vermiştir. Ancak ekonomik sıkıntılar, personel eksikliği, eski düzene alışık memurların ıslahatların gereklerini anlamakta zorlanması gibi nedenlerle hapishanelerin ıslahı Osmanlı Devleti’nin yıkılışına kadar uğraştığı bir mesele olmuştur. Bu çalışma arşiv belgeleri ışığında Osmanlı Devleti’ndeki hapishane ıslahının Antalya Hapishanesine yansımasını, hapishane binasında gerçekleştirilen tamir ve onarım faaliyetlerini, yeni hapishane binasının yapılış sürecini ve bu süreçte yaşanan zorluklarla, hapishanenin içinde bulunduğu şartları ortaya koymayı amaçlamaktadır.
In the Ottoman State, the rapid modernization movement, along with the announcement of Tanzimat Ferman, has also influenced the field of law with new laws and regulations. In many areas of personal rights, such as land and heritage law, criminal law has also been one of the topics discussed. In the world where the transition from physical punishment to restrictive punishment practice has occurred, the Ottoman State has not remained ignorant of this change. In the Ottoman state, where a transition from prison sentences to prisons was carried out in the 19th century, a milestone movement was launched throughout the country to create the physical places where prison sentences will be applied, as it is according to the provisions of the criminal law. While the European states take administrative and legal steps to repair prisons by example, the state has accelerated the construction of new prisons on the failure to obtain the desired outcome in the process that begins with the repair and repair of existing prisons. But economic difficulties, the lack of staff, the difficulty of the officials used to the old order to understand the needs of refugees have been a matter that prisons have been dealing with until the collapse of the Ottoman State. This study, in light of archive documents, aims to reflect the prison repair in the Ottoman State in the Antalya Prison, to reveal the repairs and repairs activities carried out in the prison building, the process of building the new prison building and the difficulties experienced in this process, the conditions in which the prison is located.
The modernisation movement in the Ottoman Empire was accelerated with the proclamation of the Tanzimat Edict and deeply affected the legal system with new laws and regulations. Along with personal rights, land and inheritance law, criminal law was among the many issues addressed within the regulations in various domains. The transition from corporal punishment to the practice of punishment restricting liberty had been gaining currency in the world, and the Ottoman Empire could not be indifferent to this change. Therefore, the 19th-century Ottoman Empire underwent a transition from mahbes to prisons. To this end, regulations were made in criminal law, and a reform movement was initiated throughout the country to construct appropriate buildings where imprisonment would be applied. This process began with transforming existing structures into prisons through renovations and repair, yet it did not result in the expected way, and thus the state accelerated the construction of new prisons. The Ottoman Empire took administrative and legal steps to improve prisons based on European examples, and in doing this, it prioritised the construction of modern buildings that could meet the needs within the means. However, due to economic difficulties, lack of personnel, and the difficulty of officials accustomed to the old order to understand the requirements of reforms, the reform of prisons remained an issue that the Ottoman Empire struggled with until its collapse. In light of archive documents, this study aims to reveal how the prison reform in the Ottoman Empire was carried out in Antalya Prison, focusing on the renovation and repair of the prison building, the construction process of the new prison building, the difficulties experienced in this process, and the conditions of the prison.
