Celal Nuri, Osmanlı son döneminde Batıcılık fikrinin önemli savunucularındandır. Bu fikir akımı içerisinde hukukçu kimliği ile ön plana çıkar. Dönemin hukuki meselelerine dair yayımladığı makale ve kitaplarla etkili olmuş bir isimdir. Hukuk-ı Aile Kararnamesi, Türk hukuk tarihi bakımından önemli bir yere sahiptir. Tanzimat’tan sonra çıkarılan kanun metinleri arasında dönemin fikir akımlarından etkilenmiş olması itibariyle de dikkate değerdir. Bu makalede batıcı fikir akımının hukukçu temsilcisi olarak Celal Nuri’nin kararname üzerindeki etkisi tartışılmıştır.
Celal Nuri is one of the important defenders of the idea of Batchism in the last Ottoman period. This idea comes in front of the identity of the lawyer. It is an influential name with articles and books published on legal matters of the period. The Law-i Family Decree has an important place in terms of Turkish law history. It is also worth noting that the texts of the law that were drawn out after Tanzimat were influenced by the time's ideas. This article discussed the impact of Celal Nuri on the decree as a lawyer representative of the immersive idea flow.
Celal Nuri is one of the most important advocates of Westernism in the last period of the Ottoman Empire. It comes to the forefront with the identity of a jurist in this current of ideas. He is an influential figure in his articles and books on the legal issues of the period. The Code of Family Law has an important place in the history of Turkish law. It is also noteworthy that it was influenced by the intellectual currents of the period among the texts of codes issued after the Tanzimat. In this article, the effect of Celal Nuri's ideas on the code was discussed. In addition to meeting his request for a legal regulation on family law; the views of the marriage style, age of marriage, multiple marriages and divorce are parallel with the provisions of the code.
