5237 sayılı Türk Ceza Kanunu’nun 220. maddesinde ‘suç işlemek amacıyla örgüt kurma’ suçu düzenlenmiştir. Aynı kanunun 314. Maddesinde ise ‘silahlı örgüt’ suçu düzenlenmiştir. Ayrıca, Terörle Mücadele Kanunu'nda da terör örgütlerine ilişkin düzenlemelere yer verilmiştir. Temel olarak suç işlemek amacıyla kurulan tüm örgütler Türk Ceza Kanunu’nun 220. Maddesinde yer alan unsurlar çerçevesinde incelenmekle beraber, kanunda sayılan belli suçları işleme amacı güden ve silahlı olan örgütler ‘silahlı örgüt’ olarak adlandırılmıştır. Bu doğrultuda terör örgütü, diğer suç örgütlerinden siyasi amaçları benimsemiş olmaları nedeniyle ayrılmaktadır. Yasa koyucu da bu ayrıma göre kanunda iki ayrı suça yer vermiştir. Bu makalenin amacı hem kavramsal hem de pozitivist bir yaklaşımla Türk Ceza Hukuku’nda suç örgütü ve terör örgütü kavramına ışık tutmaktır.

Abstract:

According to article 220 of the Turkish Criminal Code No. 5237, “organization for the purpose of committing a crime” is committed. 314 of the same law. In the article, the “Armed Organization” was committed. In addition, the Anti-Terrorism Act also includes the provisions relating to terrorist organizations. Basically, all organizations established for the purpose of committing crime are the Turkish Criminal Code 220. In the framework of the elements contained in the article, the organizations that are aimed at committing certain crimes listed in the law and armed are called ‘armed organizations’. In this direction, the terrorist organization is separated from other criminal organizations because they have adopted political purposes. According to the law, two separate crimes have been imposed in the law. The objective of this article is to keep the concept of criminal organization and terror organization in the Turkish Criminal Law in light with both a conceptual and positivist approach.
