Arazi yönetimi uygulamalarının en yoğun yaşandığı alanlar planlı sahalardır. Bu alanlarda; sosyal donatı alanlarının kamu eline geçmesi, sağlıklı kent dokularının oluşturulması ve kentlerin ihtiyacı olan imar parsellerinin elde edilmesi için en etkin arazi yönetimi uygulamaları uygulanmaktadır. Bu süreçte tespit edilen düzenleme sahaları içerisinde özel kanunlara sahip taşınmazlarda yer alabilmektedir. Özellikle kültür ve tabiat varlıklarını içeren taşınmazlar ile tescilli yapılar ve doğal koruma alanları, bu alanların mücavirinde yer alan parseller açısından imar kısıtlılığına neden olmaktadır. Bu tür özelliğe sahip taşınmazların yer aldığı imar uygulama bölgelerinde, imar altlıklarının oluşturulması, imar parseli üretme ve tescil safhasına kadar ki süreçler sürdürülebilir arazi yönetimi açısından nasıl olmalıdır? Konunun yasal, teknik ve kurumsal içeriklerinin ortaya konularak bu tür alanlarda bu özellikli taşınmazlardan dolayı yaşanan arazi yönetimi sorunları ve çözüm önerileri örnekler üzerinden verilecektir. Ayrıca vakıf taşınmazlardan olupta cami, medrese, han, hamam niteliğinde olan ve korunması gerekli taşınmaz kültür varlıklarının tespiti, tescili yanında mülkiyeti vakıf olmayan bu tip taşınmazlarda Vakıflar Genel Müdürlüğünün işlemleri incelenecektir. Bunun yanında kültür varlıklarından olan uygulama imar planında korunması gerekli taşınmaz kültür varlığı korunma alanında kalan özel ve tüzel mülkiyetteki taşınmazların mevcut durumu da incelenecektir. Çalışma sonunda özel ve tüzel kişilere ait bu tip taşınmazların İmar Kanunu uyarınca Arsa ve Arazi Düzenlemesi (AAD) kapsamında kamuya kazandırılması üzerine yeni bir model önerilerek çalışma tamamlanacaktır. The areas where the land management practices are most intense are the planned fields. In these areas, the most effective land management practices are implemented for the public hand of social equipment areas, the creation of healthy urban tissues and the obtaining of the building parcels that the cities need. In this process, the regulatory spaces that are identified within the special laws may be included. In particular, non-mobile and registered structures and natural conservation areas, which include cultural and natural assets, cause immaculate restrictions in terms of the parcels in the competition of these areas. How should the processes in the areas of construction where the non-mobiles with such characteristics are located, the creation of the construction substrates, the production and registration stage of the construction parcel and the processes in terms of sustainable land management? The legal, technical and corporate contents of the subject will be presented through examples of land management issues and solutions proposed due to these specific displacements in such areas. In addition, the foundation is from non-moving and the establishment of non-moving cultural assets that are in the nature of the mosque, medrese, han, hamam and are necessary to protect, the registration of the property and non-moving foundation in this type of non-moving will be examined by the foundation’s general directory. In addition, the current state of non-mobile property in the private and legal property remaining in the field of conservation of the necessary non-mobile cultural property to be protected in the application building plan will also be examined. The study will be completed by proposing a new model on the publication of these types of non-mobile persons belonging to private and legal persons in accordance with the Immar Act under the Land and Land Regulation (AAD).
