“Hac ibadetindeki bazı uygulamaların vadî hükümlerden “sebeple” olan ilişkisi konulu makalemizin gayesi; konu hakkında sebep-hüküm arasındaki bağlantıyı, bu ibadetin son bulduğu vakti, mezheplere göre değerlendirip fıkıh usulündeki gerekçeleriyle birlikte temellendirerek ifade etmektir. Bu konu hakkında gerek klasik kaynaklarda ve gerekse günümüz kaynaklarında birçok çalışma bulmamız mümkündür. Fakat konunun zamanla ilişkili olan tarafının müstakil bir başlık altında değerlendirmeye tabi tutulmasına rastlanmamıştır. Araştırmamızda mümkün olduğunca fıkhî mezheplerin görüşleri mukayeseli olarak ortaya konulmaya gayret edilmiştir.
Aslı itibariyle teklifi gerektiren bütün hükümler; ayın, dünyanın ve özellikle de güneşin hareketlerine göre hayat bulmakta ve önem kazanmaktadır. Bu durum da zaman kavramının ibadetler için vazgeçilmez olduğunun önemli bir göstergesidir. Fıkıh usulünde zaman sadece namaz, oruç ve hac ibadetleri için “sebep” olarak kalmamakta, bu ibadetlerin dışındaki diğer ibadetler için de önem ifade etmektedir. Meshin geçerliliğinde, kurban kesmede, zekât vermede ve diğer ibadetlerde başlangıç ve bitiş vakitleri Müslümanların yükümlülüklerini ifa etmede vaktin çok önemli bir disiplin olduğunu somutlaştırmaktadır.
İbadetlerin gerçekleşmesinde; sebep, şart, mâni gibi vadî hükümler mükellefler açısından zihinlerde birtakım sorular meydana getirmektedir. Konunun önemi sebebiyle Şâri’in güneşin batışına bağladığı hac ibadetiyle ilgili olarak güneşin hareketleri ve bu hareketin uygulamaya olan etkileri ve sınırları araştırılmıştır. Hac ibadetinde uygulanan birtakım menâsik hakkında fakihlerin ihtilafı, bu ihtilaflardaki râcih görüşler ve bu görüşlerin delilleri birlikte zikredilerek fıkıh usulündeki vadî hükümlerle ilişkilendirilmiştir.
Araştırmamızda ilk olarak fıkıh usulündeki vadî hükümlerden; rükün, şart, sebep, illet ve mâni hakkında kısaca bilgi verilecektir. Daha sonra güneşin batmasının hac menâsikini gerçekleştirmedeki yeri değerlendirilecektir. Buna bağlı olarak sırasıyla: Gün batımından önce Arafat’tan Müzdelife’ye inmek, gün batımına kadar Arafat’ta vakfe yapmak, Cemretü’l-Akabe’nin vakti, teşrik günlerinde geceleyin taş atma, Mina’dan erken dönmek isteyen kimsenin durumu ve son olarak da Mina’dan ayrılmaya niyetlenip hazırlanan kimsenin Mina’da gecelemesi konuları değerlendirmeye tabi tutulacaktır.
The purpose of our article is to express the connection between the reason and the judgment on the subject, the time that this prayer ends, by assessing according to the disciples and based on the reasons in the fictional procedure. However, the subject has not been found to be subject to an assessment under a particular title that is related to time.
