Libya mülkiyet rejimlerinde yüzyıllardır geçirdiği dönüşümlerle doğrudan bağlantılı olarak siyasal yapısında da dönüşümler geçirmiştir. Ülkenin içerisinde bulunduğu mevcut siyasal atmosferi anlamak için bu dönüşümlerin incelenmesi önem arz etmektedir. Çalışma, Osmanlı İmparatorluğu’ndan günümüze Libya’da mülkiyetin kısa bir tarihçesini ortaya koymayı hedeflemektedir. Mülkiyet meselesinin hukuki ve siyasi üstyapıların oluşumundaki belirleyici rolü dikkate alınarak mülkiyet rejimleri üzerinden Libya siyasal tarihi ve Libya anayasaları incelemeye konu edilmiştir. Bununla birlikte aynı bakış açısıyla Libya’da mülkiyet hakkının tarihi de çeşitli yönleriyle ortaya koyulmuştur. Bu yaklaşımla incelemeye Libya’daki Senûsiyye hareketinin etkisi de dikkate alınarak Osmanlı İmparatorluğu döneminden başlanmıştır. Ardından İtalyan kolonizasyonu ve Libya’nın bağımsızlığa kavuşması süreci özellikle mülkiyete ilişkin hukuki hükümler üzerinden incelenmiştir. Libya Krallığı’nın kurulması ve 1951 Anayasası’nın hazırlanması, Kaddafi’nin devrimi, rejimi, sözde anayasa olarak kalsa da rejimin anayasal nitelikteki metinleri siyasal tarih ve mülkiyet tarihi açısından ele alınmıştır. Nihayet Kaddafi sonrası Libya’nın içerisinde bulunduğu politik karmaşa mülkiyet ve sınıf ilişkileri bakımından değerlendirilmiştir. İç savaşın ve mevcut rejimsizlik durumunun sınıfsal mahiyeti mülkiyet üzerinden analiz edilmeye çalışılmıştır. Çalışma, iç çatışmalarıyla uluslararası gündemi meşgul eden Libya’yı, konuya ilişkin yabancı literatürü tarayarak doğrudan siyasi rejim ve mülkiyet ilişkisi temelinde ele almayı ve Türkçe yazında bir eksikliği gidermeyi hedeflemektedir.
Libya has undergone transformations in its political structure directly correlation with the transformations in its property regimes over the centuries. It is important to analyze these transformations in order to understand the current political atmosphere in the country. The study aims to present a brief history of property in Libya from the Ottoman Empire to the present day. Considering the determining role of the property in the formation of legal and political superstructures, Libyan political history and Libyan constitutions have been analyzed through property regimes. In this respect, from the same perspective, the history of the property rights in Libya has been presented in various aspects.Therefore the study starts from the Ottoman Empire period, taking into account the influence of the Senussiyya movement in Libya. And the Italian colonization and the process of Libya’s independence are examined, especially through the legal provisions about property. The establishment of the Kingdom of Libya and the drafting of the 1951 Constitution, Gaddafi’s revolution, his regime, and the constitutional texts of the regime, even though they remained as a fake constitution, are analyzed in terms of political history and property history. Finally, the political mess in post-Gaddafi Libya is evaluated in terms of property and class relations. The class character of the civil war and the current regimeless state has been analyzed through property. The study aims to examine Libya, which has occupied the international agenda with its internal conflicts, directly on the basis of the relationship between political regime and property by reviewing the foreign literature on the subject and to fill a gap in the Turkish literature.
