Türkiye, 2000’li yıllarda iç ve dış dinamiklerin etkisiyle siyasal, sosyal, ekonomik ve yönetsel alanlarda yoğun bir değişim sürecine girmiştir. Bu sürecin yönetim dinamiklerinde yarattığı değişim değerlendirildiğinde kamu yönetiminde onlarca yıldır var olan bürokratik kültürden vatandaş odaklı hizmet kültürüne geçişin amaçlandığı görülmektedir. Siyaset kurumu, bu geçiş sürecinde bürokrasiden hizmet alan vatandaşların da etkin, verimli ve kaliteli hizmet alma hak ve taleplerinin bilinciyle bürokrasiyi sorgulamasını ve denetlemesini amaçlamıştır. Vatandaşların bürokrasiyi sorgulama ve denetiminin gerçekleştirilebilmesinin yolu vatandaşların hakları konusunda bilinçlendirilmesi ve hakkın aranabilmesi için gerekli hak arama mekanizmalarının oluşturulmasından geçmektedir. 2000’li yıllarla birlikte Türkiye’de, demokrasi ve insan haklarında görülen olumlu gelişmelerin de etkisiyle, hesap vermeyen, gizlilik ve kapalılığın hüküm sürdüğü geleneksel bürokratik yapının şeffaf ve hesap verebilir bir bürokrasiye dönüşümünde Bilgi Edinme Hakkı Kanunu, Cumhurbaşkanlığı İletişim Merkezi (CİMER), Kamu Görevlileri Etik Kurulu, Kamu Denetçiliği Kurumu (Ombudsman) ve Açık Kapı gibi hak arama mekanizmaları hayata geçirilmiştir. Çalışmada, hak kavramı, hak arama mekanizmaları, işlevleri ve sözü edilen mekanizmaların bürokrasinin dönüşümüne olan etkileri değerlendirilmektedir.
Turkey has entered a process of intense change in political, social, economic and administrative areas under the influence of internal and external dynamics in the 2000s. The change that this process creates in the dynamics of the administration is considered to be the aim of the transition from the bureaucratic culture that has existed for decades in the public administration to the citizen-oriented service culture. The political institution aimed at questioning and monitoring the bureaucracy with the awareness of the rights and demands of citizens who serve by bureaucracy during this transitional process to get effective, efficient and high-quality services. The way the citizens’ bureaucracy can be questioned and controlled is through the creation of the necessary rights search mechanisms for the awareness of citizens’ rights and the right to be sought. With the 2000s in Turkey, with the influence of the positive developments seen in democracy and human rights, the law on the right to obtain information in the transformation of the traditional bureaucratic structure, which is not accountable, privacy and secret, into a transparent and accountable bureaucracy, the Presidential Communication Center (CIMER), the Ethical Board of Public Officers, the Public Audit Board (Ombudsman) and the Open Door, rights search mechanisms have been implemented. The study evaluates the concept of rights, the searching mechanisms, the functions and the effects of the aforementioned mechanisms on the conversion of bureaucracy.
In 2000s, Turkey has entered an intense process of change in political, social, economic, and administrative areas under the effect of internal and external dynamics. When the changes introduced by this process on administrative dynamics are taken into account, it is seen that it is aimed at switching from a bureaucratic culture, which exists for decades in public administration, to a citizen-focused culture. During this process, politics has aimed at enabling citizens who get service from bureaucracy to question and monitor bureaucracy with their awareness of right and demand of getting active, efficient, and quality service. Citizens’ questioning bureaucracy and monitoring it are achieved by raising the awareness of citizens about their rights and by the formation of mechanisms that are required for claiming rights. With the effects of advancements in human rights and democracy, some mechanisms such as Right to Information Act, Presidency’s Communication Center, Board of Ethics for Civil Servants, Ombudsman Institution, and Open Door Service which are used to claim rights have been put into practise in Turkey in 2000s, having a role in the transformation of the unaccountable traditional bureaucracy, where confidentiality governs, to a transparent and accountable bureaucracy. In this work, the concept of right, mechanisms of right-claiming, its functions and the effects of above-mentioned mechanisms on the transformation of bureaucracy are evaluated.
