Bu çalışma ile, Fikirtepe kentsel dönüşüm süreci, Prof. Dr. Ruşen Keleş’in kamu yararı kavramı ve kente karşı işlenmiş suçlara yönelik görüşleri çerçevesinde sorgulanmıştır. Çalışmanın hedefleri arasında Fikirtepe Kentsel Dönüşüm Projesi’nin yasal süreci ve plan kararlarının incelenmesi ile kamu eliyle yaratılan fazladan rantın açıklanmasının yanı sıra, rantın paydaşlarının ve paylaşım sürecinin irdelenmesi yer almaktadır. Çalışma kapsamında öncelikle kentsel dönüşüm planlarının öngördüğü imar hakkı artışı sonucunda meydana gelen kentsel arazi rantı ve planların niteliğinden kaynaklanan fazladan rant incelenmiştir. Ardından kentsel dönüşüm sürecinde rol alan aktörler ile meydana gelen rantın paylaşım sürecinde sahneye çıkan ve Fikirtepelilerce “Çantacı” olarak adlandırılan manipülatörler tanımlanmış olup aynı zamanda rantın sürece dahil olan aktörlerce hangi oranlarda bölüşüldüğüne açıklık getirilmiştir. Ayrıca Fikirtepeli hak sahiplerinin kentsel dönüşüm sürecinden beklentileri ve süreci algılayış biçimleri tartışılmıştır. Son aşamada ise Prof. Dr. Ruşen Keleş’in kentsel arazi rantı, kamu yararı kavramı ve kente karşı işlenmiş suçlara ilişkin görüşlerine yer verilmiştir. Çalışmanın sonuç kısmında ise Fikirtepe’de hayata geçirilen Kentsel Dönüşüm Projesi Prof. Dr. Ruşen Keleş’in kamu yararı kavramına ve kente yönelik işlenmiş suçlara yaklaşımı çerçevesinde değerlendirilerek Fikirtepe Kentsel Dönüşüm Süreci’nde kamu yararı kavramından söz etmenin mümkün olmadığı ve projenin kente karşı işlenmiş bir suç niteliği taşıdığı ifade edilmiştir.
In this study, Fikirtrepe Urban Regeneration Process was questioned within the frame of the concept of public interest proposed by Prof. Dr. Ruşen Keleş and his views on crimes against the city. It was intended to examine the legal process of the regeneration to give an account of the rent created by the state and, to analyze the sharing of the rent. The study primarily examined the urban land rent resulting from the increase in the zoning rights envisaged by the urban regeneration plans. Then, light was shed on the actors who took part in the process and the distribution of the rent among the partners. In addition, discussion was held on the expectations of the former landowners in Fikirtepe from the urban transformation process and their perception of the overall process. Finally, Prof. Dr. Ruşen Keleş's views were brought regarding urban land rent, the concept of public interest and crimes against the city. As a conclusion, it was pointed out that it is not possible to refer to the concept of public interest in the Fikirtepe Urban Regeneration Process and that the project is a crime committed against the city.
