Engelli bireyler, toplumda yaşayan en dezavantajlı kesim olarak nitelendirilmekte ve sosyal hayatın tüm alanlarında bariyerlerle karşılaşmaktadırlar. Her birey gibi engelli bireyin de sosyal, kültürel, iktisadi hayata katılması en tabii hakkıdır. Bu durum sosyal devlet anlayışını benimseyen ülkelerin engelli dostu sosyal politikalar üretmelerini sağlaması için en önemli kriterdir. Sosyal politika sahasında yer alan engelli politikaları Avrupa Birliği süreciyle gerçekleşmeye başlamıştır. Sürecin, Türkiye’deki sosyal politika düzenlemelerinin gelişimine sağladığı olumlu katkı açıktır. Bu çalışmada sosyal devlette engelli politikaları, Türkiye’de ve Avrupa Birliği’nde engellilere yönelik yasal düzenlemeler karşılaştırılmaktadır. Çalışmanın amacı, karşılaştırma sonucunda elde edilen bulgular ışığında Türkiye’nin engelli dostu politikalarının ortak noktasını tüm engelli bireylerin insan haklarından eşit düzeyde faydalanması için önerilerde bulunmaktır.
Persons with disabilities are classified as the most disadvantaged part of society, and they are faced with barriers in all areas of social life. As every individual with disabilities, it is the most natural right to participate in social, cultural, economic life. This situation is the most important criterion for the countries adopting the concept of social state to ensure that they produce disabled-friendly social policies. The disabled policies in the field of social policy have begun to occur through the European Union process. The process is clearly a positive contribution to the development of the social policy arrangements in Turkey. This study compares the policies of disabled people in the social state, the legal regulations for disabled people in Turkey and the European Union. The aim of the study is to present the common point of the disabled-friendly policies of Turkey in light of the findings obtained in the comparison to recommend that all disabled persons benefit equally from human rights.
Disabled individuals are described as the most disadvantageous part living in the society and meet barriers in the all branches of social life. Like every individual, participating in social, cultural and agricultural life is the right of every disabled individual, as well. This situation is the most important criteria to enable countries, adopting the social state understanding, to produce disabled-friendly social policy. The disabled politics taking part among the social politics area started to take its shape with the European Union process. The positive contribution of the process to the development of Social Politics regulation in Turkey is clear. In this study, the disabled politics in the Social State, legal regulations in Turkey and European Union are compared. The aim of the study is to make suggestions for all of the disabled individuals to benefit equally from human rights under the light of discoveries attained as a result of the comparison.
