Avrupa Birliği Adalet Divanı’nın (ABAD) 19 Ekim 2017 tarihinde verdiği İstanbul Lojistik kararı, siyasi gelişmeler nedeniyle kesintiye uğrayan Gümrük Birliğinin güncellenmesi çalışmalarına yeniden ivme kazandırmak açısından çok önemlidir. Bilindiği üzere Türkiye-AB Ortaklık hukuku, malların, kişilerin ve hizmetlerin serbest dolaşımı alanlarını kapsamaktadır. Ortaklık hukuku Türk kamuoyunda daha çok kişilerin serbest dolaşımı ve vize serbestisi açısından verilen kararlarla bilinmektedir. Özellikle 1987 yılından itibaren Avrupa’da yaşayan Türk vatandaşlarının Ortaklık hukukundan kaynaklanan haklarının korunmasına yönelik açılan davalarla elde edilen hukuki kazanımlar, ne yazık ki bir süredir AB’ye üyelik müzakereleri nedeniyle geri plana düşmüş gibi gözükmekteydi. Ancak Divan’ın bu yeni tarihli kararıyla birlikte, Gümrük Birliği ve taşımacılık alanında Türk firmalarının önüne çıkarılan engellerin Ortaklık hukukuna aykırılık teşkil ettiğinin tespiti göstermektedir ki; Ortaklık hukuku Türkiye-AB ilişkileri açısından hala en önemli hukuki dayanağı oluşturmaktadır. Bu çalışmada, ABAD’ın İstanbul Lojistik kararının en önemli noktaları tespit edilerek, Türkiye-AB Ortaklık hukuku açısından hukuki analizi yapılacaktır.
