İlk olarak kara taşıtlarında denenmeye başlanılan ve yapay zekâ sistemiyle (artificial intelligence system) kontrol edilen sürücüsüz araçlar deniz ulaşım araçlarında da kullanılmaya başlanmıştır. Nitekim Tesla, Nissan ve Daimler gibi dünyaca bilinen otomobil üreticileri sürücüsüz araçların en geç 2020'ye kadar yaygın bir şekilde kullanılmasını planlamaktadırlar. Denizcilik sektörü içerisinde önemli bir yer teşkil eden deniz taşımacılığı sektörü, bu teknolojik gelişmenin gerisinde kalmayacağını göstermiştir. Gemilerde boyutların gittikçe artması, kullanılan teçhizatın karmaşıklığı ve ileri teknoloji gerektirmesi, kullanılan yakıtın çevreye en az zarar verecek şekle ve yenilenebilir bir enerjiye dönüştürülmesi çabaları, özellikle de deniz kazalarında tüm önlemlere rağmen insan hatalarının olumsuz etkisinin bertaraf edilememesi ve soruna yönelik yapılan çalışmaların da yetersiz kalması teknolojik bu gemilerle ilgili çalışmalara hız kazandırmıştır. Artık dümeni kaptanların değil, yapay zekânın kullandığı gemilerin inşası tasarlanmakta ve hayata geçirilmesi planlanabilmektedir. Buna karşın gemilerde yapay zekâ kullanımı, karşılaşılabilecek birçok sorunun da çözümlenmesi gerekmektedir. Denizde eşya taşımacılığı faaliyetinde, örneğin denize, yola ve yüke elverişliliğin sağlanması donatanın ve işletenin sorumluluğunun yeniden belirlenmesi taşıyanın yüke gelen zıya ve hasar ve gecikme zararlarından sorumluluğu sorumsuzluk kayıtları ve bu savunmalardan yararlanabilecek kişilerin kapsamının belirlenmesi sorumluluğun sınırlandırılması kurtarma faaliyetlerinin icrası, çatma ve müşterek avarya gibi deniz kazalarında sorumluluk gibi temel sorunlara ve bunlarla ilgili sorulara milli ve uluslararası hukukta cevap bulunması gerekmektedir. Bu çalışmada gemilerde yapay zekâ sistemi kullanımı açıklanacak olup, bu gemilerin kullanılmaya başlanmasının mevcut kanuni düzenlemelere etkisi ve özellikle uluslararası sözleşmelerde değişiklik gerekip gerekmeyeceği konusu irdelenecektir. Yapay zekâ sisteminin denizciliğin diğer alanlarında kullanımı ise incelenmeyecektir.

The construction of ships used by artificial intelligence is no longer designed and planned to be implemented. However, the use of artificial intelligence in ships also needs to be solved with many problems that can be faced. In the activities of goods transportation in the sea, for example; the provision of sea, road and cargo convenience; the re-identification of the responsibility of the equipment and operations; the liability of the carrier for the damage and damage and delays to the cargo; the determination of the scope of liability and the persons who may benefit from these defences; the limitation of liability; the responsibility of the rescue activities; the responsibility for maritime accidents, such as collapse and customer accident and the relevant questions must be answered in national and international law. This study will describe the use of artificial intelligence systems on ships, and the impact of the launch of these ships on the existing legal regulations and, in particular, the need for amendments in international agreements. The use of artificial intelligence in other fields of marine will not be examined.
