Tapu sicili sistemine hâkim olan ilkelerden tapu sicilinin açıklığı ilkesine göre, tapu sicili herkese açıktır. Ancak, bir kimse başkasına ait tapu sicili bilgilerini incelemek ya da bu sicilden örnek almak isterse ilgisini inanılır kılması gerekir. 4982 sayılı Bilgi Edinme Hakkı Kanunu’na (BEHK) göre, Türk vatandaşı olan gerçek kişiler ile Türkiye’de tescilli tüzel kişiler, ilgisini inanılır kılmasına gerek olmaksızın hem kendisiyle ilgili hem de bir başkasıyla ilgili bilgiye veya belgeye kolaylıkla ulaşabilme imkanına sahiptir. Bilgi edinme hakkı ile tapu sicilinin açıklığı ilkesine ilişkin TMK m. 1020/II hükmü, kişinin kendisiyle ilgili tapu sicil bilgilerini istemesi halinde birbirini tamamlayıcı niteliktedir. Ancak, başkasına ait tapu sicil bilgilerinin istenmesi durumunda bilgi edinme hakkı ile TMK m. 1020/II hükmü arasında ilk bakışta bir çatışma varmış gibi görünmektedir. Bu nedenle her iki kurum arasındaki ilişki ve aralarında bir çatışma olup olmadığının değerlendirilmesi gerekmektedir. Bu bakımdan çalışmamızda, bilgi edinme hakkı ve tapu sicilinin açıklığı ilkesine ilişkin bilgilere yer verilerek, BEHK’de yer alan hükümlerle TMK m. 1020/II hükmünün arasındaki ilişki ve buna bağlı olarak TMK m. 1020/II hükmünün zımnen yürürlükten kalkıp kalkmadığı hususu değerlendirilmiştir.
According to the principle of clarity of the taboo register, the taboo register is open to everyone from the principles that govern the taboo register system. However, if a person wants to examine or take a sample from this record, his interest must be believed. According to Law No. 4982 on the Right to Information (BEHK), the real persons who are Turkish citizens and the legal persons registered in Turkey have the possibility of easily accessing information or document concerning themselves and someone else without having to make their interest believed. Article 1020/II of the TMK concerning the right to obtain information and the principle of transparency of the taboo register is complementary to each other if the person requires the information of the taboo register concerning himself. However, it appears that there has been a conflict at first sight between the right to obtain information in the event of the request of someone else’s taboo registration information and the provisions of TMK m. 1020/II. Therefore, it is necessary to evaluate the relationship between the two institutions and whether there is a conflict between them. In this regard, our work has included information on the principle of the right to access information and the clarity of the register, the relationship between the provisions contained in the BEHK and the TMK m. 1020/II provisions and therefore the matter whether the TMK m. 1020/II provisions are out of force.
