Abstract:

Kanun yolu, davanın taraflarınca yanlış olduğu iddia edilen kararların, tekrar incelenmesi ve değiştirilmesini sağlamak amacıyla tanınmış bir hukuki imkandır 1 . Mahkemelerin, karar verirken yanlışlık yapma ihtimali bulunduğundan her hukuk sisteminde kanun yolu müessesesi kabul edilmiştir. Ancak kanun yollarına başvurma imkanı sonsuz değildir. Medeni Usul Hukukunda bu yollar; istinaf, temyiz, karar düzeltme ve olağanüstü hallerde yargılamanın iadesi olmak üzere dört tanedir HUMK m. 426/A vd. .
