Nassların, sübûtu katî, delâleti hükümlere katî olabileceği gibi zannî de olabilir. Nassların, sübûtu ve delâleti katî olan hükümlerinin her türlü yoruma kapalı olduğu görüşü hâkimdir. Öte yandan nassların, sübutu katî, hükme delâleti zannî olanlar ile sübûtu zannî, hükme delâleti katî olanlar veyahut hem sübutu hem de delâleti zannî olanları da bulunmaktadır. Zannî nasslar, daha geniş bir alanı kapsamaktadır. Bu tür nasslar, müçtehidin içtihat alanı olup değişime ve yoruma açık olduğu görüşü hâkimdir. Neticede nass ve içtihat alanı diye iki alan bulunmaktadır. Müçtehidin alanı, nassların zannî alanıdır. Bu bağlamda nassların, katî ve zannî alanlarının birbirinden ayrılması gerekir. Katî alanların zamanlar üstü genel geçer, evrensel ilkeler olup değişime ve yoruma kapalıdır. Zannî alan, sosyo-kültürel, sosyo-ekonomik ve sosyal-siyaset gibi disiplinlere bağlı olduğundan; bu alanda şartlar ve sosyal gerçeklik sürekli değişimi ve terakkiyi zorladığından; bu alan sürekli tecdidi de gerekli kılar. İslâm huku-kunun bütün çağlara hitabı, bu zannî alandaki (özel) nassların hükme delâletinin, genel vahiy olan aklın içtihat dinamizmiyle sağlanır. Müçtehitler, problemlerin çözümünde, bu zannî nasslardan hüküm istinbat ederken; mantıksal istinbat metotlarını, usul denetim yöntemlerini benimsemişlerdir. Sosyal hukuk alanındaki nassların, doğru anlaşılması, yorumlanması ve uygulanması hiç kuşkusuz ayrı bir tecrübe, metodoloji ve üslu-bu gerektirir. Öyle ki Müslümanlar, Kur’ân’ın hükümlerinin katî ve zannî, genel ve özel olduğuna bakmaksızın vahyolunduğu dönemden kıyamete kadar geçerli ve evrensel olduğuna inanırlar. Keza Müslümanlar, Kur’ân intizamının gerçekleşmesinin temel rüknünün bu nassların anlaşılmasında yattığına da inanırlar. Bütün problemin, bu nassların doğru anlaşılması, yorumlanması ve uygulanması olduğu anlaşılmaktadır. Öte yandan Müçte-hitler ve bilginler, İslâm hukukuna yürürlük sağlamak için tarihten günümüze “eserciler ve reyciler” temelinde, ya “kıyası” genişletmişler, ya “istihsan ve istislah” yöntemini benimsemişler ya da, din ve şeriat ayrımı, nesh kuramı, şûrâ ile icmâ prensibi, illetin değişimi ilkesi, mekâsıd teorisi, tarihsellik ve evrensellik yöntemi, örf ve adet hukuku, hakikat ve mecaz gibi farklı kavramlara yükledikleri benzer anlamlar ile aynı gayenin tahakkuku için yürürlük sağlamaya çalışmışlardır. Bu durumda, içtihat alanında, ciddi bir kavram kargaşası yaşandığından, farklı kavramlarla ayni gayeye yönelseler de kavramlara yükledikleri anlam farklılığından kavram dövüşü yasanmış, sonuçta yazılı veya sözlü ittihat da çoğunlukla sağlana-mamıştır. Bu bağlamda çalışmamızda nassların doğru anlaşılması, yorumlanması ve uygulanması konusunda en büyük etkiye sahip olduğunu düşündüğümüz içtihadın mana değeri üzerinde durulacaktır.
