Deniz ticaretinde olası denizcilik rizikoları donatanlar açısından ağır sorumluluklara yol açmaktadır. Donatanlar denizde karşılaşabilecekleri tehlikelere karşı sorumluluklarını sigorta sistemi sayesinde teminat altına alabilmektedirler. Sigorta türlerinin ilk örneklerinden olan deniz sigortaları çok eski dönemlerden beri deniz ticaretinde öncü olan ülkelerin uygulamaları sonucunda günümüze kadar gelişerek gelen bir sigorta türüdür. Türkiye’deki düzenlemeler esas itibariyle batı hukukunun etkisi altındadır. Günümüzde uygulanan başlıca deniz sigortası türleri tekne sigortası, yük sigortası, kulüp sigortası ve zorunlu mali sorumluluk sigortası şeklindedir. Eski Türk Ticaret Kanunu’nda (1956) deniz sigortaları özel olarak düzenlenmekteyken, yeni Türk Ticaret Kanunu’nda (2011) bu konunun genel kurallara tabi bir sigorta türü olarak düzenlendiği görülmektedir. Bu şekildeki bir düzenleme deniz sigortaları bakımından bazı sorunları da beraberinde getirmektedir. Sorunların ortaya konulması ve çözüm arayışı çalışmanın konusunu oluşturmaktadır.
Possible maritime risks in maritime trade lead to heavy responsibilities in terms of those equipped. The crew can take responsibility for the dangers they may encounter in the sea through the insurance system. Sea insurance, which is one of the first examples of insurance types, is a type of insurance that has evolved to date as a result of the practices of the countries that have been the pioneer in the maritime trade since very ancient times. The regulations in Turkey are mainly under the influence of Western law. The main types of maritime insurance that are applied today are boat insurance, cargo insurance, club insurance and compulsory financial liability insurance. The former Turkish Trade Act (1956) specifically regulates maritime insurance, while the new Turkish Trade Act (2011) shows that this issue is regulated as a type of insurance under general rules. This form of arrangement also brings some problems with the sea insurance. Discovering problems and seeking solutions is the subject of work.

While marine insurance was specifically regulated in the old Turkish Commercial Code (1956), it is seen that this issue was regulated as a type of insurance subject to general rules in the new Turkish Commercial Code (2011). Such an regulation also brings some problems in terms of marine insurance. Putting forward the problems and seeking solutions are the subject of the study.
