İnsan haklarının korunmasına ilişkin uluslararası sözleşmeler devletlerin ulusal hukuklarını etkilemekte, onları uluslararası standartlarla uyumlu düzenlemeler yapmaya sevk etmektedir. Türkiye de, Avrupa Konseyi’nin bir üyesi ve Avrupa İnsan Hakları Sözleşmesinin bir tarafı olarak, iç hukukunu Sözleşme ile uyumlu hale getirmekle yükümlüdür. Bu uyuma konu olan haklardan birisi de hâkim önüne çıkarılma hakkıdır. Bu hak, ceza muhakemesinde uygulanan yakalama ve gözaltı tedbirlerine maruz kalan kişilere tanınmaktadır ve kişinin keyfi olarak özgürlüğünden yoksun bırakılmasına karşı bir güvencedir. Bu çalışmada, Türk hukukunda hâkim önüne çıkarılma hakkına ilişkin düzenleme ve uygulamalar ile Sözleşmenin kişi özgürlüğü ve güvenliği hakkını düzenleyen 5. maddesi ve buna ilişkin içtihat mukayeseli olarak incelenmiştir. Bu bağlamda ulusal hukukun Sözleşme ile uyumlu olup olmadığı irdelenmiş ve sonuç olarak hâkim önüne çıkarılma hakkı ve buna ilişkin uygulamaların içtihat ve dolayısıyla Sözleşme ile büyük oranda uyumlu olduğu savunulmuştur.
The international treaties on the protection of human rights affect the national law of the States and encourage them to make arrangements in accordance with international standards. As a member of the Council of Europe and a party to the European Convention on Human Rights, Turkey is also obliged to make its domestic law consistent with the Convention. One of the rights that are subject to this sleep is the right to be brought before the judge. This right is recognized to persons who are subjected to the arrest and arrest measures applied in the criminal trial and is a guarantee against the person’s pleasant deprivation of freedom. In this study, the provisions and practices of the right to be judged in the Turkish law and the right of the person to freedom and security of the Convention. It has been examined as a substance and as a comparison of it. In this context, it is argued whether national law is consistent with the Convention and as a result the right to be brought before the judge and the practices related to it are drunk and therefore largely consistent with the Convention.
International conventions affect the national laws of states and encourage them to make necessary regulations in line with international standards. Turkey, as a member of the Council of Europe, and as a State Party to, is obliged to make compliant its domestic law with the European Convention on Human Rights (ECHR). The right to be brought before a judge is guaranteed under the ECHR. This right is a guarantee against the arbitrary deprivation of liberty. The current study scrutinizes the regulations and practices regarding “the right to be brought before a judge” in Turkish law including the article 5 of the ECHR. After questioning whether Turkish municipal law complies with the ECHR, the study argues that the regulations regarding ‘the right to be brought before a judge’ and related practices in Turkey are substantially in line with the case law and thus with the ECHR.
