Abstract:

In the last century, the Ottoman Empire changed the bureaucratic structure of the state in order to capture the economic, technical and military developments in the world. Because the reforms to be carried out could only be planned and implemented by a qualified and trained organization. In such an environment, the creation of the State Council in coordination with the stated aim is one of the most important parts of bureaucratic transformation. The Shura State, on which the foundations of the Council of State, which is one of the judicial organs, are based, is an important milestone in the history of the Turkish administrative judiciary. One of the important innovations in the judicial leg of the structural reforms and transformations of the institutions that started in the bureaucracy of the Ottoman period is the creation of The Shura State institution. Sultan Abdülaziz’s effort are important and valuable in the establishment of Shuray-State, which was opened in 1868 by drawing inspiration from historical background such as the Divan-ı Humayun, Meshveret assemblies, Majlis-i Vala-Yi Ahkam - ı Courthouse, which is very important in the tradition of the state and which are institutionalized examples of the Shura principle. The Shura State became an important institution within the bureaucracy of the Ottoman Empire with its authority in the preparation of law regulations, its supervision authority for the activities of the administration and some judicial functions. In the light of the data obtained by scanning State Archives, encyclopedias written about the last period of the Ottoman Empire and scientific studies prepared about the state, the descriptive method is preferred and the reader’s mind is intended to envisage the period in question.
