Sosyal devlet ilkesinin bir gereği olarak devletin asli görevlerinden biri sosyal adaleti sağlamaktır. Devlet bu görevini gerçekleştirmek için sosyal ve ekonomik hayata müdahale ederek, çalışma hakkı gibi Anayasal olarak herkesin sahip olduğu bir hakkın kullanılmasını kolaylaştırıcı tedbirler alabilir. Özellikle toplumsal olarak korunması gereken bazı kesimler için Devletin zorunlu istihdam politikaları yürütmesi, sosyal adaletin sağlanmasında pozitif ayrımcılık uygulamalarına önemli bir örnek teşkil eder. Türk hukukunda zorunlu istihdam politikasından yararlanabilen hassas kesimler engelliler, sosyal hizmet modellerinden yararlanan kişiler, eski hükümlüler, terörle mücadelede malul sayılanlar ve/veya yakınları ile hayatını kaybedenlerin yakınları ve terörle mücadelede malul sayılmayacak şekilde yaralananlar olarak karşımıza çıkmaktadır. Bu kapsama giren kişiler, zorunlu istihdam politikasının bir gereği olarak özel sektörde veya ekseriyetle kamuda istihdam hakkından yararlanabilmektedirler. Bu kişilerin, kamuda istihdamı için aranan koşullar ise, kamu personel rejiminin genel çerçevesinden farklı özellikler arz etmekte söz konusu kesimin istihdamı için birtakım kolaylıklar devlet eliyle getirilmektedir.
The principle of social state is that one of the primary duties of the state is to ensure social justice. By intervening in the social and economic life to fulfill this duty, the State may take measures facilitating the exercise of a right which is constitutionally all persons possess, such as the right to work. The implementation of the obligatory employment policies by the State, especially for certain sections which must be protected socially, is an important example of positive discrimination practices in the provision of social justice. In Turkish law, sensitive sections that can benefit from the compulsory employment policy are disabled, people who benefit from the social services models, former prisoners, those considered goods in the fight against terrorism and/or relatives and relatives of those who lost their lives and those who were injured in the fight against terrorism. Those entering this scope may benefit from the right to employment in the private sector or in the public, as a reason for the mandatory employment policy. The conditions that these persons are seeking for public employment are different from the general framework of the public staff system; a number of facilities for the employment of the respective section are brought by the government.
