Abstract:

Medjelle-yi Aḥkām-i ʿAdliyye, one of the first laws prepared on the basis of Islamic law, has formed the ground of many discussions even after it was abolished. For this reason, Medjelle has been included as the subject or source of many scientific studies, especially in the field of fiqh and law. Two important texts belonging to Medjelle stand out on the basis of these studies: Manuscript Text approved by the Sultan and the official Dustūr Text based on this text. But there are differences between the Manuscript Text and the Dustūr Text to the extent that some expressions. Sometimes it is observed that some of the expressions that should exist are not present in the mentioned texts. In some expressions, there are obvious errors in both texts. It has been necessary to make a comparison between the two most important texts in order to create the most accurate Medjelle text that can solve these problems. In this article, the findings obtained as a result of the meticulous comparison of the two texts about Medjelle were shared with the scientific world. Thus, it is hoped that studies on Medjelle will be instrumental in achieving more reliable and more accurate results.
