Gelişen toplumsal olaylar ve anarşik ortamın yaygınlaşması ile Türk Silahlı Kuvvetleri 12 Eylül 1980 günü yönetime el koymuştur. Toplumsal düzenin sağlanması ve demokratik ortamın oluşması için toplumun ihtiyacı olan Anayasa yapma ihtiyacı olduğu kararlı bir biçimde kamuoyu ile paylaşılmıştır. Danışma Meclisi bünyesinde Anayasa Komisyonu oluşturulmuş ve oluşturulan komisyonun başına Prof. Dr. Orhan Aldıkaçtı getirilmiştir. Anayasa Komisyonunca hazırlanan ve Milli Güvenlik Kurulunun incelemesinden geçen Anayasa metni 7 Kasım 1982 günü yapılan halkoylaması sonucu; %8.63 “RED” oyu verilmiş ve %91.37 “KABUL” için oy verilerek kabul edilip, 9 Kasım 1982 tarihinde yürürlüğe girmiştir. 1982 Anayasası, 1961 Anayasası ile getirilen hak ve özgürlüklere bir tepki olarak, hak ve özgürlükleri sınırlamayı seçmiştir. Ayrıca yaşanan parlamenter rejimin tıkanıklıklarını gidermek için; Cumhurbaşkanına parlamenter rejimde olmayan V. Fransız Anayasasından esinlenerek Yarı Başkanlık Rejimindeki, Cumhurbaşkanlığı yetkileri verilmiştir. Çalışmamızda 1982 Anayasasında 2010 tarihine kadar yapılan değişiklikleri ve getirilen yeni düzenlemeleri; Anayasa Hukuku ve Siyaset bilimi açısından inceleyeceğiz.
With developing social events and the spread of the anarchist environment, the Turkish Armed Forces took over the government on September 12, 1980. It is firmly shared with the public that the society needs to make the Constitution to ensure the social order and the formation of a democratic environment. In the Council of Advisors, the Constitutional Committee was established and created by Prof. Dr. Orhan Aldıkaçtı. The constitutional text, prepared by the Constitutional Commission and reviewed by the National Security Council, was the result of the publication of 7 November 1982; 8.63 percent of the votes were given "RED" and 91.37 percent of the votes were accepted for "CABUL" and entered into force on 9 November 1982. The 1982 Constitution, in response to the rights and freedoms introduced by the 1961 Constitution, chose to limit rights and freedoms. In addition to removing the barriers of the parliamentary regime, the President was given the presidency powers in the semi-presidential regime, inspired by the French Constitution which is not in the parliamentary regime. In our study we will examine the amendments to the Constitution of 1982 until 2010 and the new regulations introduced; Constitutional Law and Political Science.
