Günümüz demokratik siyasal sistemlerinde siyasi partiler temel ve vazgeçilemez unsurlar olarak kabul edilmektedir. Bu durum siyasi partilerin sistem içerisinde üstlendikleri ve yürüttükleri işlevlerden kaynaklanmaktadır. Şüphesiz ki siyasi partiler bu işlevleri yürütürken belli finansman kaynaklarına ihtiyaç duyacaklardır. Çünkü bu işlevlerin yürütülmesini sağlayacak faaliyetlerin mali açıdan oldukça önemli bir boyuta ulaştıkları bilinmektedir. İşte partilerin gerçekleştirecekleri faaliyetler için ihtiyaç duyacakları finansman kaynakları ise oldukça çeşitli kalemlerden oluşabilmektedir. Bunların başında gerek konumuz itibariyle önem arz etmesi gerekse de diğer kalemlerin karşısında oldukça önemli bir büyüklükte olması hasebiyle devlet yardımları gelmektedir. Bu çalışmada esas olarak siyasi partilere devlet yardımının hukuki yönünün konuyla ilgili yürürlükteki mevzuat hükümlerinin hem anayasal hem de yasal düzlemde açıklanmasına çalışılacaktır. Sonrasında devlet yardımının hangi mali boyutlarda olduğunun da ortaya konulabilmesi açısından partilere yapılan son beş yıldaki devlet yardımları değerlendirilecek ve son olarak da siyasi partilere devlet yardımının olumlu ve olumsuz kabul edilen yönlerinin incelenmesi amaçlanmıştır.
In today’s democratic political systems, political parties are considered to be fundamental and indispensable elements. This is due to the functions which the political parties take and perform within the system. Certainly, political parties will need certain funding resources when performing these functions. Because it is known that the activities that will enable these functions to be carried out have reached a very significant financial dimension. This is the source of funding that the parties will need for the activities they will carry out, and it can be made up of quite a variety of pennies. In the first place, it is necessary to emphasize the importance of our subject, but in the face of the other pen, it is very important that the state aid comes. This study will mainly seek to explain to political parties the current legislative provisions on the subject of the legal aspect of state aid in both the constitutional and legal levels. The State aid for the past five years will be evaluated in terms of the financial dimensions of the state aid and, in the end, the aim of the political parties is to examine the positive and negative aspects of the state aid.
Political parties are accepted as essential and indispensable elements in today's democratic political systems. This situation derived from the functions that political parties undertake and carry out within the system. Undoubtedly, political parties will need spesific financial sources while carrying out these functions. Because, it is known that the activities that will ensure financially the execution of these functions have reached a very important level. Here, the financial resources that parties need for their activities can consist of quite a variety of items. The most important of these is state aids, which are important in terms of our subject and because they are very large compared to other items. In this study, fundamentally the provisions of the current legislation on the subject, the legal aspect of the state aid to political parties will mainly be tried to be explained in both constitutional and legal level. Thereafter, it is aimed to examine the state aid given to parties in the last five years in order to reveal the financial dimensions of state aid. And finally, the positive and negative aspects of state aid to political parties will be included.
